Can someone of more senority take my hours

I recently became full time. This lady I work with has been with Krogers longer and was once full time but volunteerly became part time. Now she wants full time and told me she could take my hours if she wanted because I have only been at Krogers for a year and she has been there for 5..is that true, even though I am Full time now?

it depends on how long she has been with Kroger.  If she has, say 4 years in as full time then she goes to part time, her seniority tenure gets chopped in half to 2 years.  Then she decides to go back to full, well yea she has higher seniority. Does that make sense?

I would check with your union representative.  I may be wrong but I would think your co-worker would have to work  x number of weeks @ x number of hours to retain her full time status. I dont think that she can just request to be full time again @ a moments notice. PLay it safe and call your  Rep

 Yes that makes sense, I don't know how long she has been full time, hopefully not long enough to bump me out....lol

Check your contract but as far as I know, she can't do that. A part time person can only claim seniority over other part time people.  Therefore she can only claim the hours of other part timers.  Besides, just because she wants her full time back doesn't mean that Kroger is going to give it to her.   Under my contract part time seniority is based on hire date.  Full time seniority is based on the date you become full time.  Part time and full time seniority lists are kept separate and one can't claim hours from the other.  If a full time person goes back to part time they are removed from the full time seniority list and placed back on the part time seniority list.

I happen to have my union handbook nearby. Lets see what I can drum up from the Local 700 book.  Lets see if I can confuse matters better.  I am just writing things as I read.

Article 9: Seniority

Section E is all about scheduling guidelines by seniority.

Part of E-1 does state that "for the purpose of this paragraph full time employees shall have seniority over part time employees."

E-1 however seems to apply to employees hired before 1989, which seems to be neither of you.

E-5 Says something to the effect of whatever shift preference, in this case the willing part time hours might count I would imagine, must persist for six months at a minimum.  If so how long has it been since she asked for part time?

F Part time employees will not accumulate seniority over full time employees.  Full Time employees seniority starts at hire if they started full time or date of promotion if they were promoted to full time.

In summary, as it is applicable within my contract I see nothing that prevents her for exercising an existing amount of full time seniority over you to take your shifts.  I am probably missing something here but it looks like she can bump you for hours, but by itself she cannot just magic herself back into full-time.  She would have to go through all of the crap of the ten week, 36 hour average stuff.

Corporate is hoping that she will try so that they will be able to possibly get a chance to drop you from full-time as well.  Definitely an interesting question and certainly something your rep should look at.

Out of curiosity, is she actually moving to do this or was it just something mentioned off hand?

But if they give up their full time they give up their seniority over other full time people.  Under my contract if you are part time you can only claim hours of other part timers.  When it comes to scheduling, full time people are given their hours first and then part time people are given their hours according to seniority and availability.  Once you become full time the only way they can take it away is if there are no hours for any part time workers and you're at the bottom of the list of full time workers.

If she became part time on her own accord, I don't think she can just go and claim hours on a full timer regardless of her seniority, especially if she's restricted in any way. In the local 700 contract, part timers ( or full timers, for that matter) with restricted availability have basically no seniority. Besides, I think all she can do is claim preferential shifts on seniority at this point, not hours. I'd have to see the specific contract to know for sure.

in my contract it says

the employer will construct weekly work schedules by department,classification and the ability to perform the work for full-time, such that the basic weekly full-time schedule shall be eight (8) hours daily and forty (40) hours weekly, scheduled in five (5) days, not necessarily consecutive,sunday through saturday inclusive.

it's more likely than not the same for you if your full time and it's hours your worried about you should get 40 hours

Some managers tend to favor the hard workers over the lazy ****head workers, even if their seniority is above the good workers. I suppose I don't mind that because that's how it really should be in the place of employment. Hard workers should get the very best if they're going to give the very best. Kroger used to notice the people who worked really hard by a pay raise and such. Nowadays, Kroger really has changed.

No because you are full time. Full time people need 40h. She cannot take your full time

Nope. Once she gave up her full time, she lost her seniority.
