Firing most of the Deli soon?

Okay, so last week the deli manager at my store said that two people were getting fired. Then this week said four people were getting fired. My part in this is that I was randomly written up the other day for stepping outside to smoke, there is a side door near the deli that people from three departments use to do the same thing. All of this is on the clock which was the write up. But my thing is that literally every smoker in my store does this. I'm in the union but don't really know what to do with them. Should they contact me or should I contact them? I have no idea if I'm one of those four, but other people in the deli do stuff way worse than taking five for a cigarette.

You will need to contact them and you need to stop taking extra breaks. In the future, you need to include your cigarette breaks within your 30 minute break.

My shift is always 5pm-11pm so I get fifteen minutes break. When I was hired the manager in the bakery (where I started) said you got fifteen on the clock and I've just been going on that until the other day when I got written up.

Then if you were actually on the break when you got written up, you could have refused to sign. But only if your manager/supervisor said " ok go take your 15." If you just went on without telling anybody about your break then te write up May still be valid. Check with your union.

You werent randomly written up. You were on company time outside smoking. You know the rules, just because others do it you think its ok? So your blaming the others for your write up and possible firing. LMAO

Pretty sad you were written up and possibly fired over smoking cigs. Maybe you need to get help with that problem when you get fired.

I was just doing what every smoker does in my store. That includes associates up to the co-managers. Hell the co manager who wrote me up asks to smoke together.

 If everyone else jumps off a cliff, are you going to jump too?

You are not permitted to smoke while you are on the clock.  Period, end of discussion.

I take my 2 15 minute breaks and 30 minute lunch break and use it to smoke.  I do not sneak outside to get a quickie fix.

The point isn't exactly what I'm thinking you are seeing it as though. My point is I was trained to have just one 15 minute break a day. Fine. I was told I could split that into two 7 minute breaks and use that to smoke. Also fine. My point is that I was told when I was getting trained that it is an on the clock break. Apparently that's not the case. And that is my argument here.

Whoever told you that is stupid. There is no "on the clock" breaks... the contract says specifically that you have to clock out for your breaks. Whoever told you that needs written up then.

I was told that before our store was remodeled and before I joined the union for that matter. He doesn't work at our store anymore though. I just want to know how to fix my situation though because I enjoy working through college at kroger.

Yeah, I have had another night grocery manager from another store help us out.  He said that they do not clock out for breaks.  I have been taught to always clock out for breaks.  It depends on how your store managers want things done.

Your best option is to ask your store co manager(the one that wrote you up) the rules and ignore anything else you have been taught.  The write-up is a corrective action to help you do things the correct way.

Maybe ask your union steward first to see if it is wise to ask the store manager.

Ok, you got a write-up.  No big deal.  It is only one and either a warning or the first step.  There are 3 or 4 steps to write-ups before termination.  Stay out of trouble for 6 months or a year and this write-up should not be a problem anymore.  I am suprised you did not get fired on the spot for stealing company time.  You can call your union steward in the office to help you whenever you are getting a write-up if you think it is wrong.

I'm not the OP, but that part isn't necessarily his fault.

 

This is Kroger we're talking about. There is no form of consistency in between stores, let alone between different people within the same management.

 

I'm sure you can already tell that there are PLENTY of people here on this site who do NOT clock out for breaks. I myself have never done so, and have been told that I didn't have to clock out if I will take my breaks in the break room (instead of heading out to the nearest restaurant). All this coming from management and those who are above me (shocker, eh?).

 

But, it's only one store. I'm sure you've read somewhere along the lines that people do in fact take smoke breaks at the back of the store. I see it done in other Kroger stores even when I just drive around the back to take shortcuts. I don't smoke, but that doesn't mean I would rat out the co-managers, department heads, and other employees who do take a smoke break.

 

Unfortunately, that's not uniform across all Kroger stores and any of her subsidiaries. Otherwise, we wouldn't be having this discussion.

 

Point of the matter is, it's not just the OP who's 105% at fault like you're making it sound like.

I would agree with this from what i have seen since i have been working at Kroger. Big differences on how people,employees do things at my store.

Point of the matter is, it's not just the OP who's 105% at fault like you're making it sound like.


 I realize each store has different policies on the break clock out.  I work with too many slackers so our store can't use the honor system.  And, yes, I know of people that walk out the side door or back door for smoke breaks while on the clock.  That is their job on the line, not mine.  When they get caught and fired, it will be their choice.

The person who taught the OP to take 7 minute breaks is no longer at the store.  Managers and co managers change all the time.  So, the best option is to follow the current store managers' rules.

The OP is 105% responsible for his job.  He is concerned about being fired over this.  He needs to start doing things the correct way in order not to get fired.  The Deli manager saying 4 people are going to get fired sounds like they are full of hot air and just trying to stir **** up.  The Deli manager does not get to decide who gets fired but can snitch on people until they have enough write-ups and eventually do get fired.

If the OP is being fired, then he needs to get a union representative quick.  I realize working evenings that may not be possible.  The OP can ask the union rep to fight this current write-up.  It won't hurt.  It will atleast make the break rules for everyone in the store clear.

Not to sound mean but if you're only working 4 hours, and you can't go that long without smoking, or even just smoking once during your 15 minute break, then maybe you need to try to quit. :(

Or use a vape pen. It's cheaper, and it's healthier too depending on the nicotine amount in the juice. No nicotine is the healthiest way to go.

Just got off the phone with the shop steward. All she really said was "You'll have to talk to the union lady if you want to go that way." Exact quote. Who the "Union lady" is I don't know and what "Go that way" means try to get the write up to be taken back I GUESS. Really strange.

When I worked at Kroger, even the manager himself would smoke in the back room. On store time. Around food.

As would a certain co-manager and department lead.

I'm not a smoker so my view is pretty one-sided. I've often wondered how much time is wasted by some smokers who work at my store.

names of the union stewards in your store as well as the union rep must be posted. in my store it's near the main time clock. 

there are smokers at my store i've heard say they take three ten minute breaks instead of thirty.  well but that's not in the contract you get 15 minutes every 4 hours that we usually combine and 15 minutes more after 10 hours. 

it pisses me off because other depts get their breaks but up front days some of us full timers go without a breaks doing eight, nine or more hours is too numerous to count and there is NEVER any repercussions.  also overnight cashier doesn't get to take a break either.

 Seriously, why do smokers think that they are above the rules when it comes to their habits? Who cares about the co-mgr asking you to smoke, you got caught "stealing company time". Because that's what it is. Meanwhile, those who don't smoke and don't sneak out to grab a quick smoke (PS...it's never as quick as you think it is) is picking up the slack for the smoker who is taking a break when it isn't even their break. Bitter? Yes. Yes, I am. Sympathetic? Nope. Suck it up, literally and figuratively.

 They probably mean it's a paid break. You still have to clock in/out for the break but you get paid for it. They track it all through Kronos. They can see when you clocked out/in, if you were late, early, what have you. You're on the radar. Clock out to go smoke.
