I work at a Kroger fuel center and we have had a water leak in the box for 6 months now. The leak has knocked out our air conditioning 6 times. And we are stuck in the box in 96degree heat for the entire shift. Now we have been itching and getting rashes, having memory loss, and headaches. I got my manager to test for mold. The mold test came back positive for Cladosporium and Aspergillum mold. Both of these molds can cause brain infections, infections of the lungs, sinuses, and respiratory system. Aspergillum can even damage your spleen and liver. Kroger will not fix it or get a company to clean it. My manager keeps saying that there is no problem so I wear a surgical mask to work. Now t my manager suspended me indefinitely for wearing the mask. I have a copy of the report I got I from the union rep. How can he put my life in danger and not care about is and the box has no ventilation? This is crazy and inhuman. I work at a Kroger in Cordova TN on Germantown Pkwy.

I thought about that. Thank you. EVERYBODY acts like they are so scared of Kroger. But, I am not. That is why I posted the location. Our supervisor has red bumps all over her face and she recently had to be treated for thyroid problems and takes medicince daily for it. The Aspergillus mold damages your thyroid gland too, but she is too scared to complain or wear a mask or do anything to get us help or sue. The mold report has high levels and the box is so small that it is emitting the mold spores into the air outside through the little hole where customers put money. Even our walk up customers scratch sneeze and cough when they come up to the counter. I just don't get why our store manager is ignoring this.

But, the union rep is ignoring it too. Because he gave me the report because I pressed the issue but shouldn't everyone that works in the box have been notified of mold that can cause them infections????? Duh... And, we all pay union dues!!!? This is Crazy. The union rep called the mold testing company and verified the report and that the CAN harm us but he is not pressing Kroger to clean it up... Why? What is wrong with them??? Nightmare! And, We can not have health insurance in the fuel center.

Call the County Health Dept. They will be out tomorrow. They will shut the place down. You will be a hero!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Also you will have a guaranteed job for life because Kroger cant risk a whistle blower lawsuit.

I forgot to mention that you may not have health insurance, but there is workers comp insurance.  Huge claim here!!!!!

In our Atlanta market, if something like this happened, we'd go to the Atlanta news stations. All of them. CBS (Channel 46), ABC (Channel 2), NBC (Channel 11) and FOX (Channel 5).
And if you have paperwork to back up your claim, that's a bonus.
The investigative reporters wouldn't even need to show up in a marked news van.
Just hand you a video camera or sneak one in there and take home video of the affected areas.
Add the video + paperwork and you've got a story that the Atlanta investigative news teams would die for.

I have pictures. And the mold report. The report was done on July 25 and we are still suffering. And he had nerves to suspend me. I have kids I'm taking mold spores him to.

Someone else called our county health department but they said they do not handle mold issues when they came out. They said we have to call the code enforcement. However, the water leak is inside the walls. And lots of bugs are coming out of the walls and that is where the source of the mold is I'm sure. But, Kroger does not want to cut the wall open. They are doing nothing.

I really wanna sue because I spend alot of money on oils for my skin rashes and detergents and disinfectant sprays because of this problem and I have breathing issues. I'm a woman with 2 kids and I have to protect them from this and I'm worried about our health. Does anyone have ANY idea why the store manager Would ignore tho problem and the union rep would too??? Please give me any ideas you have.

No idea why a store manager would ignore this. Maybe they don't think it's a big deal. Or maybe they're just too afraid of expenses to get it fixed. Doesn't really matter, does it?

Lawyer up, dude. At least get a consultation. Tell them what you've told us, show the mold report, medical documentation if you have any, pictures, whatever. A decent lawyer can help figure out the best way to go about this.

it sounds like the union is in the companys pocket. I have been with Kroger a long time and my union does not want to help us workers anymore.

Contact your union rep and file a grievance. File a report with OSHA.

I did contact OSHA and they stated to me that TN has does not have any limits set for air quality and TN has their own rules set for OSHA standards. I contacted the OSHA office here in Memphis and never heard back from them. No response. That's what I get for being in a Republican State Police State huh???? The Republicans want to raise the retirement age. They want us to work ourselves to death literally! ... And, that is what I would be doing in that box at Kroger for $8.30 an hour and killing my home and my kids... All I did was go to work for a major company I thought was good and my store manager (James Taggart) has Madeleine sure that even though I perform my duties assigned to me and I am overly friendly and customers love me I am living a nightmare and Kroger does simply NOT care. I also contacted my local corporate Kroger office and they said I just need to talk he store manager. I did and he keeps lying and saying that the fuel center kiosk is clean. Yet I itch and have shortness of breath everyday I am there and so does my coworkers who are afraid to complain . I don't want them to get away with this. And I have been through so much washing my clothes and bedding each and everyday and buying clove oil, olive oil coconut oil, tea tree oil, and colloidal silver constantly and borax and laundry detergent to kill these mold spores and not let it harm my kids with every agency unable to help me or unwilling . It is a nightmare. With no end. I do not understand. I want to make sure that they do not get away with this and some air quality standards are set in TN and mold standards as well. This is not fair to me or my family or my co-workers. Why does kroger and the union think that this unfairness is acceptable? I want them to get that it is NOT acceptable and be penalized for it. I think Taggart should lose his job and Kroger should repay me for all the money I have lost due to this situation and pay for my health care.

OP SHOULD call, I know it's his/her call but whose to stop another co worker/former employee from calling in? That's a LIFE THREATENING health hazard. It CAN cause SERIOUS PROBLEMS in those who already has bad health issues. What's the manager going to do a CUSTOMER calls in the Healthough Dept or Media? Ban him/her for life? Suspend them?

 

i would it. Too many health issues. And if it is done, Management can't LEGALLY do a DAMN thing about it...ESPECIALLY if you have documentation. Whatever you choose to do OP, KEEP THOSE DOCUMENTS, EVEN THE PICS!!! The documents will help you keep your job should managememt seek revenge and TRY to fire you for calling them out

Suspended Indefinitely is not good. That means that management is going to drag this out as long as they can. Store management, human resources and the union will stick together like glue, especially if an employee is calling them out on a health issue like that, which would make the company look really bad in the public eyes. Just a little advice for you...be ready for a long drawn out process. Document everything, get signed statements from your co workers who are also aware of the situation, that is if they are willing to sign anything for you in fear of losing their jobs. Forget the union....you will be fighting your own case. If the union decides to take your case, it could go to arbitration which is a very long process. Like other posts have said, get a lawyers input if you want to take them on for legal reasons, otherwise be prepared for it being you against them and it will get ugly. It is sad but true, unless you are financially prepared for this....they will win, remember they got lots of lawyers to fight their cases, most employees don't. Very sorry to hear about your situation. I would really like to see someone finally stick it to this company, only because there have been so many good employees unfairly targeted, retaliated against, wrongly accused and finally forced out of their jobs and the good ol' union very aware of it and not doing nothing about it!

just left the union. They are taking my case seriously. But I do know that I have to take action for myself. Attorney found and says that I do have a good case...smiles And Thanks to GOD!!! Thank all of you for your advice and support.

Good luck with your case. Keep at it. NOBODY should have to work in conditions hazardous to ones' health. Including douchebag managers. I believe you will fare well in this case should it go to court. Keep documents, any pictures, and any doctor visit paperwork at the ready. This will be of help in front of a judge

Thank you. I am keeping up with all documents. I will give copies to the law firm in a moment but keep all records and documentations in my possession at all times. I am using my time off very wisely today. I was very sad yesterday when suspended but today much better. But, I do have a headache from the mold yesterday. However, my spirit is lifted.

There's no way you can lose. If they even TRY firing you for this.... you could sue the corporation so fast they won't know what hit them. I don't get HOW they've let it go the way it is for so long.

Ok. Now they are calling her to come back to work tomorrow! But, she can not wear the mask. See, This is happening to my sister. I told her to blog about it or go to the media but she didn't want to for fear that it may be something she will get attacked for. Now, I wonder if it they called her back because they are trying to set her up or is it that if she accepts the terms and goes back will they then say she made her own self sick? I don't know what Kroger is up to but I do not want my sister sick or dead.f

Something is NOT right... Why call her back?? If I were your sister, I'd be asking "why? What for?" I'm STILL going through with this irregardless.

If she does go back then she should NOT sign ANY paperwork unless she reads it and understands it first.

It's up to her, but I'm just saying what I would do if it were me.

I have not and will not sign ANYTHING! That is what myself and my fam are trying to pick up on...Why did they ask me back... I think it had something to do with this forum personally. We can not figure it out... The store manager that suspended me is off on Wednesdays... However, the Comanager called and asked if O would come back on tomorrow with NO mask of course. I will get sick and they know it and then what? This is inhuman...

Mine died about three months in.
I won't go into the details for the umpteenth time because you can find them on here in my other posts, both anonymous and as this handle.

Basically, I was written up for insubordination in early June after complaining to a FES of mine whom had come out to the parking lot to check on things.
Manager, whom I affectionally have dubbed "Super B-i-t-c-h", said to me during the conversation in their office, "You could leave now and we would be okay with that."

The STATEMENT was meant that, should I have chosen to verbally quit on the spot right then and there, that I would have left with good terms and possibly a reference if needed.
What she MEANT as a KROGER MANAGER was "We can find some schmuck to do your job, probably still in high school, and you are as expendable as toilet paper at a construction site's porta-john."

.......That was pretty much the day I said the hell with it. Lost all emotional connection to my work. It became just a job. Not something to look forward to anymore.
I always thought, or tried to think, before then that I was making a difference somehow. Helping total strangers in their lives. After that meeting, the sky went from blue to gray within moments.

Kroger seems to be pretty good at killing peoples' ambition.
We should send some of their execs to Syria and we could end the civil war there within days.

Glad to hear it.
This company is bullcrap when it comes to that sort of thing.
I always tell my co-workers, old and new, that this company is NOT worth risking your health.
I tell my fellow courtesy clerks when we are in the parking lot and it's 90 + degrees with a heat index in the triple-digits, that, if they feel tired or hot, to take a break on their own.
Don't clock in on your official break. Just go rest for five or ten minutes. Screw it, I don't care HOW busy we are or HOW much the carts are needed.

This company is NOT worth risking your health, life or limb for.
Thank god the idiot manager who sent me and another courtesy clerk back outside during a clearly-still-occurring lightning storm has left our Kroger and gone to another district.

If you feel you have to do this, then do it. I hope for your sake it goes well, but if you have the evidence that you claim, it could.
