So here's the basics: I'm on the overnight grocery crew. My dept manager was stepped down from the position two years ago before regaining the position a few months ago. She orders more than we can put up in an 8 hour shift. Her solution to that is to try and get everyone to stay longer. 

My problem is that my car died and I'm using an in-law's car to get to and from work, and I need to have it back to the house at a certain time every morning. If I start conditioning and putting my back stock away, she starts to lose it. She'll start threatening to cut my hours if I don't stay longer, or threaten to get me off of the stock crew. I've only been with the company for about 7 months, some of the old timers tell me that she can't do what she's threatening to do if I've worked my scheduled hours (not to mention staying later).

As it stands this week, I'm coming in an hour early each day and staying an hour late, which gives me 8 hours to work as much as possible during the shift.

I really need some help here, I don't know what she can and can't do. I don't want to get a write-up for insubordination or get hauled up to the office (both things she's threatened me with) for this.

I would beat her to the punch. Go to your store manager, explain your car situation, and drop dime on her for threatening and needlessly upsetting you.

This is my fault for not mentioning it beforehand, but she's well aware of the situation. It just doesn't matter to her one bit. I'm not sure if I have anything to get her on unless she starts cursing or actually threatening me again.

Normally you and the store would have to agree on schedule changes after 12pm Saturday morning. Before that they can make changes without your consent. Some contracts allow the manager to ask you 2 hours ahead of time if you can stay and you'd be bound to it. Other contracts you would only be liable for the hours you're scheduled and do not have to work more than that even if asked to stay over... the choice is yours. You really need to ask your union person these questions. They would be more informed than we since we don't know what local or even the state you are in for us to be able to give you a proper response.


Me, personally, I'd start talking about grievances toward her for threatening you and cutting your hours to try and bully you into staying over your scheduled hours. Then start taking other peoples schedules.

Next time she starts in on you just tell her you would like to wait and discuss this when your union steward is present.  In fact, go ahead and talk to your union steward and see if y'all can get a meeting with her.  Don't let her bully you or threaten you.

 

I forgot you work nights so this might be difficult but see if your steward comes in early and find a time to talk then.
