Regardless of what is "right", what is your stores policy regarding sleeping on the clock?  

 

For example, if a person is in the break room, on the clock, sleeping for 2-3 hours on multiple occasions.

 

Would that be considered time theft? AKA reason for immediate termination  OR

Time wasted? Which would have to follow the standard procedure of verbal warning, writeup, suspension, etc.

Let's see.  You're on the clock but you're not doing your job.  That's stealing time.  I can see how it might happen once, especially if the person is used to working a late shift and then gets switched to an early shift.  It happened to me one time at another job.  I worked overnights cleaning movie theaters and I fell asleep in one of the seats while on break.  However, I didn't sleep 2 to 3 hours either.  I think it was about 20 minutes.  If it was the first time and they were normally a good employee, I would give them a warning.  However, if they did it deliberately and more than once, I would let them go.

Time theft. "Time wasted" is kind of a vague wording for anything though, because what if your manager is a douche that says "you aren't working hard enough" while you're doing double the work they are.

But sleeping for 2-3 hours is definitely stealing time.

The reason I ask, is that according to our store manager, sleeping on the clock is NOT time theft, it is time wasted. Equivalent to taking an extra smoke break or something, regardless of the vast time difference between the two. His personal stance that he employs is if the person is on the premises, it cannot be time theft. It's very frustrating to deal with, and even more frustrating when you are told that you are supposed to be constantly watching them, so it's shoved off as somebody elses fault. In fact, the person I'm referencing quite literally stole full time status by consistently staying late and getting overtime every day, nobody could check on him because everybody was gone and nobody at night had access to Kronos to check times, so nobody knew anything was wrong. After weeks of beating on management to actually do something, the most they could muster was not even a real writeup, but an SIR for unauthorized overtime. Absolutely nothing for sleeping on the clock.

Sounds like your store manager is NOT committing time theft themselves.

Send a complaint to HR or LP. 

I knew of a CC that would take his break.  Then, clock back in and go back into the break room to continue taking a break.  He was terminated.

I heard of an entire night crew terminated by LP for taking extra breaks.  Not sure how true that is tho.

Refusing a job assignment then.  He is sleeping instead of working so he is refusing to do the job assigned him.

 The entire night crew would be fired except for 1 person outside of department head/backup if they were to employ that here.    I'm on good terms with all management here, I don't want to go above their heads.   But I will be watching and seeing if it continues to happen, and pressing management to act.   It sends a really bad message to everybody else if somebody is allowed to do things like that.    I hear all the time from everybody else, "Why should I have to do anything if x gets to do all that and get away with it.  I'm untouchable unless they act on them"

 

Also what you said about the CC is what he does here.   Clocks out for 30 minute lunch, clocks back in then heads back into the break room.  I had his time sheet pulled and compared it with the times that we found him asleep.
