Here is the deal at my store, I work in the fuel Department and was told when I started that we got two 15-minute breaks a day and I have been here for almost 4 years and still have not received one break we aren't allowed to have a microwave or a fridge but they can keep us in this little building for 8 hours straight with no breakes, is this reason to file a grievance? And also i have been told when you do file a grievance, you are punished by management an have your hours shortened.

Which would be another grievance . . . and an ethicspoint report.

Talk to your fellow fuel people.  What needs to happen is that EVERYONE insists on receiving breaks, per policy, per the contract, instead of everyone going along with allowing management to deny you breaks.  Make management wrongdoing unacceptable rather than the norm everyone just accepts.

And there lies another problem, our fuel manager doesn't want breaks and when the district fuel leader came out she said we have to have breaks, she (district fuel manager)went and talked to management and then he(fuel lead) came in and got very mad about it and went down and told management to disregard breaks we don't want them and I've told him multiple times that I do, it's a really hard situation in all, the store doesn't care and they won't train people to learn how to work in this department to even relieve us for breaks. And it seems like our union rep does not care what should I do

Oh and I also forgot to add one day I worked a nine and a half hour shift with no breaks ,called for one and the customer service manager answered the phone, got an attitude with me because I asked for a break and said she would send one of her assistant managers down when they were done relieving people for breaks, well an hour and a half went by and I called back to remind her that I still needed a break and she said oh I sent him to break now when he comes back I will send him out and instead of sending him out when he returned from break, she took her break and I never got a break at all. So like I said I've been here for almost four years and I've never had a break. And that don't we pay union dues so we get breaks?

Put your concerns/issues in writing. 

The fuel lead has no authority to rescind your contract and no right to claim to speak for other associates when he clearly does not speak for them.

Indicate in writing that you'd like the company to abide by the terms of the contract, including granting the breaks owed to fuel associates.  Make photocopies for yourself, your union reps, and store management, and send the signed original to your district coordinator (who sounds like he/she intends for the company to comply; it's just more convenient for the store not to comply, but that cheating convenience is about to end).

Are the breaks supposed to be paid?  If so, imagine if you won a grievance asking for compensation for four years' worth of denied breaks!

 Generally, breaks are paid time.  Lunches, however, are not.

Legally you're entitled breaks by law.  Talk to your union rep.  Legally you can not be forgotten.  Your break and lunch are separate entities.  Not one and the same.  If it's really bad you can file a report with Kroger Ethics Commit.  Be forewarned that you will revive a locked door conversation with them, your manager(s) and a union rep.
