so I received two CAs for leaving early and not punching out for a break. The next day I find out I was being spied Im by coworkers and purposefully being paged on a headset I forgot to put on(instead of pagoing me on the intercom) to see if I complied with orders.

I was told from now on I must punch for breaks, and went back to work. For the rest of the day I did not find time to take a single break and just continued my shift. The next day, the my HR manager, who singled me out in the first place, went out of her way to check the logs to see if I punched, first trying to claim I didnt punch out for work, the saying I didnt take a break.

 

Came in today at 4pm, only to be called up by the same manager, who said I was being suspended for not taking a break. Ive spoken to my union and HR to file harassment as this has been a long running grudge against me. 

 

I dont have to take my breaks, do I? from my knowledge of the union guidelines, they just cant deny me breaks. So what is going on here?!

i dont know IF you haft to take breaks

 

But i would take them........your getting   Paid      for 15 mins to take a break

That's really sh*tty of your coworkers to rat you out for not taking a break. Those must be people who you always see on their phones, taking a "break", even if it's 6 times a day. You probably make them look bad.

It depends on your contract if you must take a break or not.

The union guidelines state member shall have a break for every half hour yada yada yada.

 

the interpretation however means I cannot be denied a paid break, but does not mean I MUST take a break

I'm entitled to breaks, but this doesn't mean I HAVE to take a break, right? Nothing in either handbooks state that I must take breaks as nothing says it's mandatory. So I got suspended for a day, and now I don't know what's next. 

 

The store manager is on vacation now, leaving the HR manager in charge. So what happens when I only take one break? Or I take two, 14 minute breaks? Two 16 minute breaks? Basically I have a few more levels to go, but I can't just get fired for my store manager being away for a week. I'm stuck and need to know if there's more I can actually do to remove these CAs from my record.

What state are you in?

How many hours are you usually scheduled?

I was told that it is mandatory to take breaks and lunch in my state.

Walmart got in trouble for not giving breaks.

Legally, per most state laws, you must take breaks.   

Never skip a break.  Don't give away your time.

And, yes, be cautious which co workers you trust.

Well if all goes wrong, blame Store Management. Breaks should be given, but technically if your never told to go on break........its their fault for not supervising you. I would also ask if their have checked anyones logs for "Break Violations" and ask them to provide the Union with associates that they have also written up for the same policy. While Store Management thinks they are GODS, you can normally just play their game with them! If your to wear a headset, ask for the official policy, which most likely their isn't one. Ask the HR Manager for your official job description and also associates handbook, so you can make sure to follow all the rule and not perform duties that are outside your responsibilities. If your a clerk, your to perform duties when your told to before them!

 I work in Indiana and there isnt a law stating lunches must be offered. The union guidelines also state the lunch must be offered, not mandatory.

 See, I am following all my responsibilities Of my job description. And yeah no one ever followed up with me asking if I had taken my break at all. Normally I have said to them i havent had a break and just say its fine.

Technically most stores do not require you to punch out for breaks. Union dictates that we have a seven minute leaniancy. You should not be fired for taking advantage of this rule. Unless it is an extreme amount of time And quite frequently. If a one or two time thing then call the union.
