One afternoon, my girlfriend who was off that day, and I who just got off work that day from Kroger were being harassed by a customer. The customer randomly says move hitch to my girlfriend. So my girlfriend replies back saying excuse me. They get into an argument and I eventually separate them from the argument and we go our separate ways. A few moments later the random the girl sees my girlfriend again and starts yelling go home bitch go home and she runs towards my girl. I run towards them both to try and prevent anything from happening. But the random girl pushes my girlfriend and I, so my girlfriend throws a punch and hits the other girl and a fight broke out. i grab ahold of the other girl and an employee who was working at the time grand a hold of my girl and the random girl was still throwing punches but hits the employee that was working. and we get them so separate. My girlfriend then picks up her stuff from the floor and the other girl tackles my girlfriend into flower displays. . We get them to separate but the random girl starts accusing me for hitting her when all I did was try to stop and prevent that stuff. I didnt hit her only grab ahold of her to stop the fight just like the employee that was working.
video proof shows that all I did was try to stop the fighting. I can understand why my girlfriend was suspended but not me. The other employee who was on the clock was not suspended, but I who was off the clock in zero uniform was suspended.
on my suspenion paper, it says I got suspended for fighting when I was not at all.
what are the chances of us getting our jobs back? All the managers and union people are on our side and say we didnt do anything wrong.
Technically, I believe the company can terminate/suspend an employee for anything that goes against "Core Values". In this situation, if its on camera and your not fighting/trying to break it up ....its cut and dry and they over reacted. I would challenge the suspension on the grounds of being written up for something that did not occur while on the clock. With all write-ups, its all depends on how the manager words items, just like in any legal document, its all about wording and clarity. If reality, if the manager would have written you up for not following "Core Values" and manned you from the store/other stores due to this.....there really isn't anything that can be done, unless a higher level associates voids it.

Self defense. Your girl and you should NOT have been suspended. Your girl shouldn't have thrown a punch but I dont blame her. I would have done the same thing. (To a guy. Not a female. I dont hit women, maybe push back but not hit) Kroger should have looked into it more. It seems as I'd they are more worried about their image and "losing a customer" than the welfare of their own employees. If you are with the union seek their help. Look into the laws of your state, and get hold of HR. Review tapes of it is on film. Get witness statements. Hope it all works out for you. Good luck
Call the union and challenge it. There are a couple QFC stores I worked at where we always had to break up fights and make them take it outside. Because then it's no longer a store matter. If they injure them selves for incompetence then they could sue the company for customer to customer assault. Challenge it. Say for example a customer was an ass hole to me and tried to get me fired on the clock for resisting them. My disability protects me from crap like this. I sued the company but choose to not continue it because it opened their eyes enough to make them see that not all was well in the store and they started to make changes. That was enough justice.

WORD TO THE WISE: You may be employed there but ur worst decision is to spend ur off time there- whether shopping, visiting a gf, whatever... clock out , leave , and stay out.. whatever you need u can get at Walmart or a convenience store!
