Simple question, can you be rightfully punished with a write up or worse for becoming ill on a shift and having it impair your work?doh


I figure I should have opted to go home early once I realized it was not going to get better so I can accept that, but my issue was that the Assistant Store Manager directly told me that I should have continued to work at the same pace and get the same things done, even with them knowing I was feeling very sick to point of near fainting.

This is concerning because I was basically told that I should have definitely kept working while feeling ill, and later punished for not being able to complete those tasks. That struck me as...Less than ethical, possibly against policy, possibly illegal.
I don't know for sure if I could discretely audio record this within policy or at least, without fear of retaliation as I know it would simply be denied if it was brought up without audio or video proof.

It's against company policy to secretly record conversations.  You'll definitely be fired.  I would only do it if I knew I was going to be fired anyway and I needed evidence to support a civil suit against the company.

Get a doctor's note.  Stating the fact of your illness.  It doesn't have to be the day of but within a reasonable time frame.  Say within 1-3 days.  They can't write you up for just cause.  I'd contact your union rep.  According to food safety rules we can not work if we are feavering, sick, throwing up, or ill.  Call your union rep and get it challenged and tossed.

I am a natural foods clerk, is that rule about not working if you are sick apply to all employees? since we all essentially handle food items? Just curious.
