Ethics and retaliation

I was recently moved from a large store to a smaller store, taking a pay cut after I addressed massive weights and measure concerns along with food safety (chicken leaking onto produce that they proceed to sell anyway).

 

What are my options. I have 100 pictures+ over a year or two with evidence of my merchandiser brushing off issues such as product being dramatically underweight (he sold it anyway, package said 3lb and weight of package plus product was 2.6lb).

 

I gathered all this to protect myself cause I figured something like this would happen. I kept addressing these issues till I was ignored. Then since I didn't stop I suspect I was transfered for being too vocal about it.

If it's that bad than you need to report it. It should be done anonymously to protect yourself.

The company claims to have a robust no-retaliation policy.

Have you used EthicsPoint already?

You could try division folks, say, the president.  If that fails, I'd try the top attorney (General Counsel?) in Cincinnati.

How about government health authorities?

Press the fight.

In many larger cities, TV stations have a reporter who specializes in "fighting for the consumer" or "revealing bad practices or dirty little secrets that harm the average person".  You need to try contacting your local or nearby TV stations' news departments and pushing for some publicity to fight against Kroger for it's corruption.   

Admittedly, some TV news sources will be afraid to take the challenge (especially if Kroger is one of their sponsors) but maybe others will not be afraid. I think it is worth it to try!!   This kind of thing would be a big "attention grabber" and increase viewership of their news programs, which translates to more $$$ for the TV station.  As long is you remain completely anonymous, what would be wrong in trying to do the right thing here?

It can't be anonymous as i sent the pictures up the chain. They will see it was me. The weights and measure was about a week or two prior. I was brushed off and they said it be handled tomorrow, it wasn't, a week later the same thing. Kroger's blames the manufacturer, but the continue to sell it.
Im nervous about going to the news or anything like that. I'm not a very smart person and Kroger's would probably bury me and ruin my life with petty litigation. Even if they lost I'd lose everything fighting it. 
Have not contacted the union as they seem to brush concerns off too. Maybe I should send it directly to my union president. I just been doing what I'm suppose to do and handing it up the chain.
This is wrong, it's unethical, and they just don't care.

What is the 2.6 lb. Item that is being sold as 3 lb? I'd like to weigh 1 up at my store to see if it's company wide. Thanks!

Are you a department head?
They expect you to Fix those problems if you are.
Are you an assistant department head?
They expect you to Communicate and Fix those problems if you are.

Are you just an associate who actually Knows right from wrong?  
You may want to contact your store management if you think food safety is a concern, or if there is a scale issue or intentional cheating customers...  
If you don't get much response from store management, go directly to your district coordinator- they should immediately take action or even meet with you to address your concerns.
I would go to your union LAST.  Honestly, it will just be the Most talking and meeting in the office, it will require paperwork including official write ups and suspensions or even terminations....

But most importantly-  if you Ever see a potential food hazard, you pull it from the salesfloor or from your backstock, you get a store manager there, and you explain the problem - do Not just take pictures of it and let it slide.
Other associates may need to be retrained in food safety, you can be a big help in pointing out No-no's and help them correct their bad habits!

 It has nothing to do with associates at store level, I'm not expected to fix it, I addressed it to the people I was suppose to (well over 10+ times), was told it wasn't happening, so I proved it, then said it was a one off, proved that to be wrong, then was told it would be fixed, it never was and continued into the next few weeks and months, then I was moved, once the person moved me I stop receiving any information at all or even being responded to, it wasn't solved, I was.. I talked to the union today. I don't even care about retaliation. I just want them to fix the food afety issues.  Even told the guy that.  I don't even think it's systemic, it's this one warehouse, Just quit killing people.

 3lb 80/20 chuck flavorseal. It continues to come in underweight.  The packages are very noticeable too they arnt tight and rather loose.

I think I really do need to specificy that these are coming into the store with the issues already there. Not joke issues like bad stacks. Bird shirt on pork. Literal bird feces.  Chicken drippings coating grapes. People don't even wash grapes and eat them half the time in the store. 

 

This is a very big deal for me ethically, not so much for Kroger's.

If its an item that is prepacked, it should have been someone that was communicated to your Meat/Seafood Coordinator and then they tell your Meat/Seafood Div. Merchandiser. I would suggest contacting the Hotline and have them investigate, and leave no deal out. If you reported the issue and they did not address, that would be a big issue with GO. GO only seeks out items and then its delivered to Warehouses, its up to Warehouses, Division, Store associates to report issue.....

 I followed what I was suppose to do to a fault.  I have given this to multiple people including the MR, I was assured it would be addressed with the warehouse and specific people that should get this stuff done, or start the process for a recall, something.  What Kroger's did was completely unethical and illegal.

This experience makes me believe the hotline is nothing more than a way to single out "problem" people.  Cause at this point I'd probably be reporting  the person who's desk that lands on.  So no thank you. 

 

I have been in contact with the union just to have a statement on record about retaliation, but that isn't the big deal and I told them that. This is 100% food safety.  So I told them to ignore that **** and please fix the food safety. 

 

This all started with food safety, but this long, no resolution, moving the person rather than fixing the problem, the issues still going on (in contact with previous store) and many other things.  People should be fired over this, this isn't a joke or game, these are people's lives.

Real talk, and it's 100% consistent with my experience with these abusers.

 

This experience makes me believe the hotline is nothing more than a way to single out "problem" people.

That can be fairly true, depending on your district HR person, his or her level of ethics, and how he/she interprets his/her role. When true, it's corrupt, dangerous, and tragic.

To be clear, the "hotline" is Ethicspoint.com, the third-party company Krogrr uses for . . . this purpose.  Reports seem to come back to the desk of the district HR person. 

I like typing up reports at the website so I an retain those written records.  We're documenting and reporting serious issues and urging the company to address them.  If Krogrr chooses to be grossly negligent and it hurts someone in the process, we're going to be star witnesses for the plaintiff's counsel, and our documentation is going to be important.  (Unfortunately, the plaintiffs could be a grieving family, at that point; too bad this company is too cheap and indifferent to protect its associates and the public.)

Company and union swept it under the rug. Union said there be no protection from them for whistle blowing and to report it to the health department or weights and measures. Which I can't do without singling myself out, cause again, it can't be anonymous.  By the way. I continue to find product underweight even at my new store from the exact same manufacturer that I complained about months and months ago. 

 

So with that being said, I won't be shopping at Kroger's and I'll be explaining why to friends and family, with lack of details of course.

Hopefully a customer find this and goes to the news.  This company has been nothing but scummy about this the entire time and it blows my mind how many people know in corporate, at their company headquarters, but refuse to do their job let alone what's right.  Hope anyone who saw this walks away with the same disgust.

Before anyone mentions the government protection for whistle. Blowers. I'm not smart enough for that kind of paperwork, I'd mess it up and lose by default or something.  Kroger's got a **** ton more lawyers than I do, betting their lawyers are waiting for stuff to do too.

OP here, i have the pictures logged onto 3 different locations along with my wife having a jump drive copy.  This is not going to go away at all, its just time at this point, whether they kill MORE people, or get caught and pay the minimal fine for companies who murder.  Hell i bet it doesn't stop even after they get caught.

 

They got a racket going, blame the manufacturing and save face, act like the hero when you blame them and "fix it"  Then move onto the next prepacked underweight item or false tares inserted by corporate in the scales.  The profit outweighs the human cost and the financial fines!  It just makes business sense i guess.

 

I wont be pursuing this at the moment, but i am waiting and collecting even more.
