Hi
I have worked in the same place for 8 years now on nightshift .
Ive only just found out about the working hours regulation .

my work consists of a 10. 30 pm to 9.30 am which totals 55 hours a week .
My Contract reads
" You will normally be required to work a minimum of 40 hours each week .  You may however be required to to work such hours beyond the normal hours as are necessary for the full performance of your duties .
There are sleeping facilties on the premises and it is allowed to sleep( once I have completed allocated duties etc ) .
ive also only discovered that the european courts of justice ruled that even if you are allowed to sleep while at the disposal of your employer (which I am ) this is classed as working hours .
I am also told that you have to sign an opt out agreement which appears to be incorporated into the contract which I have never signed .
Bottom line is, have I been a numpty all these years doing all these extra hours both for nothing and have my employers been breaking the law ?
Funny thing is when you calculate all the extra hours its laughable (not )

Any opinions would be welcome or would love to hear from anyone in a similar position

hmmm, well it sounds like your in a different country. This is a forum for employees of the Kroger company which is primarily (and only I think) in USA. So the laws here are very different. I doubt anyone here can answer your question. But basically over here in America it's rare for a grocery employee to work more than 40 hours on a regular basis (if they're paid hourly).

noboby signs the contract, the union tells what they want kroger and the union agrees, and that's the way it is.  you are only allowed to work 40 hours a week unless they really need you.  if you work over 40 hours a week then anything over 40 is time and a half, like you get paid 8,00 an hour if you work over 40 hours you will get paid 12.00 an hour.  if you work night crew then they either paqy you 40-50 cents more an hour over minimum wage.
