Is it too late to get my job back?

I got switched to another department earlier last year, I was at Kroger for 6 years, they would not schedule me for 2 months, the Union took their time for me of course, I finally got  32-37 hours for 3 months thanstarted working 2 jobs, they than took me off the schedule, I called the union and they never picked up, I began emailing two reps, I gave both my phone number. They got me a meeting, which they would not call and I didn't get to check my emails regularly at this point, I went out of town and checked it on a friend's computer and got a meeting which I could not make it to, I let them know beforehand and got a letter...

 

What can I do to appeal and get my job back this was October?

I would also like to note that I went from "Terminated", "Volunatry Resignation" and finally "Terminated my last day of work". according to Union Rep, My Manager and Betsy S.

Without knowing details of your situation, it would be hard for me to comment. But this is a general idea of what happens. If one is terminated for any reason ( just or not just) the first step is with the store manager.If money is involved then they will pass on it and then you go to stage two.
That would be with your district manager and that could take a few days to a few weeks. Depends on their schedule and the time for them and the union rep to talk. Again if it is going to cost money or they just want to use you as an example then they will pass on it to stage or level three.
That stage would be with your KMA HR staff or person designated to work with the union. You could be looking at another few weeks to a month or more until they get to meet and discuss your case. Now if HR decides that they are right and rejects the unions point of view, then you start looking at arbitration. That could take months. Both sides have to first find an arbiter that both sides agree on that is not done over night. Once they find one then they have to set a time where both sides can meet with the arbiter. Once that is done then there is a herring. They usually will try to schedule several arbitration cases at the same time.
The hearing is set and the arbiter could make his/her decision right there or schedule another day to meet with both side to give a decision. Usually it is decided right there. SO again you could be looking at several months to some times up to a year until it is final. If you win then you will be made whole.
Now one thing to consider is this. To go to arbitration it costs several thousands of dollars. both sides put up the money and the looser pays and the winner gets their money back. So if Kroger has gotten to the piont of arbitration then they will fight it with everything as loosing would literally cost them thousands of dollars.

also, got to remember, kroger has deeper pockets, then the union, espicially with so many union members getting axed over the last couiple of years.

used to, the union wouls fight all but the most hopeless battle.

now, they fight only the likely to win.

price of a crappy economy, unions loose a lot of strength
