90 days is usually the starting probationary period. Any time after that you can.
You can start filing grievances after 30 days, but for termination it's 90.

The job description is listed in the union contract for courtesy clerks, and bringing in carts is specifically listed as a duty. If you are considering filing a grievance (with the union) I would ask your store's union rep before going WAY over their heads to the EEOC.
There isn't much he can do at this point, because they will claim that she had a poor performance at work and claim that its not because she is pregnant, but work in general. In the 45 - 90 day period they can fire a person without having to give them any unemployment benefits or union representation. What I would do is have a sit down with the Store Manager, but I would tape it. You may need to check wiretapping laws in your state to see if it is in fact legal and presentable to the courts. If you can get the store manager to admit to firing her on the basis of being pregnant you would have a case.
I'm sorry that happened to your daughter. They claim to the public that its a "family store", but not anymore. They want to be exactly like Walmart.
