dont get hurt at Kroger

I was with Kroger 20 yrs. when they remodeled back in 2007. I was working 48 hrs. week at night as a conditioner. When I started not being able to breath, because of all of the dust in store,ass.manager told to go outside and get fresh air once in awhile. This was in May 07-by Aug.07 I was in and out of hospital over 250 days since then not including ER visits. Had to hire an attorney by Dec.07 to get workers comp started. Kroger kept putting off court dates until Sept 2012. Went to court lost, even with 2 doctors deposition's stating that it was work related, had an appeal lost that to. Kroger admitted there was asbestos in old part for store, they gave us no protection the air was so full of dust particles. I have been on oxygen for over 5 yrs. They no longer pay for my meds, which ran about 1700.00 month. They no longer pay me workers comp. I am still employed by then they gave me my 25 yr. gift in 2012. They don't even have the guts we are sorry they offer no compensation, NOTHING! I WILL ADMIT I hired the wrong attorney in Augusta, he waited over3 yrs. then he hired another attorney that dose workers comp. We went to court with him , my husband was suppose to be a witness they never used him. NONE  of my doctors depos came up the only thing the attorney was worried about was his pay for 2 yrs. Now I am at home on oxygen no meds no care except for my husband who lost his job because  and he even had FEML.ANY ONE KNOW WHAT I can do because I cant get another attorney to touch this case. I am going to file malpractice against both of my attorney's. Because KROGER IS NOT GOING TO GET BY WITH THIS when I had other workers who stated they know what we had to deal with.There are 2 other workers who are now sick one has kidney cancer because he would have a soda with him while stocking dust was getting in his drink, the other one is having heart problems, these are not people who were sick before. My husband thinks our attorney's may have been compensated in one way or another. Because the first one we hired has a legal show on Sunday nights on local TV sponsored by who else KROGER. WE had WRDW -12 COME to our house and did an inter view with us the lady went back to station e-mailed me she said her boss was interested in my story. But Kroger sponsors There local news, and she moved to Atlanta Ga.

Anyhow, that really sucks. You probably should have done more research before hiring your attorneys. I hope things come through for you.

Where's the union in all this?

I've tried to get in touch with SWEDE but he wont call me back. Like all major companies, Kroger doesn't care you are just another body that can be replaced. I've got a primary care doctor that I have seen over15 yrs. and a pulmonologist that both stated I had no lung problems prior to this except for maybe the flu and normal illnesses that every body gets. Since this the steroids they used to help me breath have eaten my bones-I've had to have total left knee replacement also had to have 2 stints put in my heart all of this was back in 2010- 3 yrs. after this happened. My pulmonologist stated I was normal before this- now he says I have lung disease severe irreversible inhalation injury and that it is lifelong. I was told by my attorney that Kroger was holding out on me hopping I would die before they had to pay for anything. I cant drive anymore need wheelchair to get around-have not left my house except to go to doctors or hospital-I cant even go to a store. There is a sickness called sick building syndrome you can look it up.And since Kroger has a private workers comp-Sedgwick they sick to you one way or until death. All I can say is GOD repays those who do wrong- its not in my hands any more I leave it up to the LORD.

First: I'm very sorry to learn of your health problems; I truly hope you get the assistance you need.

Two thoughts I have on your legal defense. The first is: You might be able to sue your first lawyer for conflict of interest. The question will be, is it his broadcast program, or is he just a guest speaker? If it's the former, I would think you have a case since he contracted Kroger to sponsor him. If it's the latter......Not so much. He's judgement proof in that scenario.

The second thought: I hope you're not trying to present those co worker's health issues as part of your claim. It's pure speculation on your part, and does nothing to strengthen your case.

Please tell us how this all progresses......Again, best to you.
