In general, many companies do not pay vacation to people that have been fired.
It was a poor choice for you to add fuel to the fire. But, you were both wrong. Both should be suspended. I still think you should fight the suspension.
I HAVE NOT been fired. I am under suspension. I am still a Kroger employee. The vacation time is mine - earned and accrued. So rightfully so I should be able to use it as I please.

No. Vacation time is earned and is paid either on a vacation or termination, provided that the person has not been terminated for cause, such as theft, then vacation is forfeited. If you are suspended pending termination, HR will make the determination and if you are terminated your vacation will be sent to you provided you were not terminated for cause.
Why would you want to use your vacation time during your suspension? Suspensions are supposed to be without pay (as far as I know; unless your with law enforcement...) however, I'd check with your Union to be 100% sure.
