"maternity" time off for fathers

My husband works for Kroger full time and we are due with our child in 3 weeks.

He has no personal days left (due to family issues) and no vacation time.

I was hoping someone could tell me i he is entitled to some sort of "maternity" leave (i cant find his handbook).

Also, if he is- is it paid time?

I have never heard of a maternity leave for fathers but that doesn't mean they don't offer it..... Best bet would be to check with his store manager or union rep..... If they don't could have him look into a leave of absence ..,.....

in some contracts they do have maternity leave for fathers, but its not paid time off.

If it's for fathers, it's called paternity leave.

One of my store's co's got a couple weeks paternity leave but i doubt it's offered for hourly employees. I could be wrong though.

FMLA applies, and they should hold your position for you (not replace you) for up to 12 weeks, BUT you have to meet this requirement:

"You've worked for your employer for at least 12 months and for at least 1,250 hours during the previous year (which comes out to 25 hours per week for 50 weeks)."

State laws could possibly come into play if you're not covered by FMLA. Varies.
