There's a really nice responsible bagger at our store who goes out of his way to help us all the time. He never missed a single shift or called in. A manager caught him smoking a cigarette on his break and wants to fire him. Can they do that? He tells us that he'll be of age in 9 months and claimed family buys them for him. I'd really hate to see the bagger go, its rare we got someone who's on top of things.

If he's that busy, maybe he deserves it. The front end is a ****ing circus. It's a wonder everyone on it doesn't smoke.
He claims that the only reason his parents support him and purchase the product for him is because it is legal under state revised statutes for a minor to accept receipt of tobacco products from family members. Not sure why they have that clause in there besides the additional tax revenue.

Sure, he can accept them, but does it mean that he can smoke them out by himself in the open, let alone in the workplace? While I'm sure that it was given to him by a family member, I don't think any authority would buy that excuse, since so many minors can just come up with that on the spot to avoid disciplinary action.
Where I live, my family members can give me alcohol, but I can't drink while at work now, can I?
The manager may be in a bad spot. They sell tobacco, it's highly regulated. If it can be shown they know an underage employee is smoking on company time, there could be trouble for the store...

The manager should warn him via word of mouth or document if he does it on company property. If he has a car and does it in there, I don't know if management can do anything or not, but if a Sting is done, the store can and will face hefty penalties. I've seen it happen before.
In the state I live in kids do it all the time at work and after school because there's a clause here that says "It shall not be unlawful for minors under the age of 18 to possess and consume tobacco products should they accept receipt from a family member." No idea where their bounds are for that one.

To add, it is this way likely because it easily generates thousands of tax dollars for them. However, it doesn't seem right to me.
