We are in the process of opening a new store and a union rep said if they can't get 51% participation in the union that the store will open as non union. Is that is even possible and would that be such a bad thing?

Yes it is, all new marketplace stores open as nonunion. They offer excellent packages which include personal days, sick days, 401, stock options, 3 weeks vacation after 5 yrs. partime associates also get personal, sick, and vacation. I work at a marketplace in richmond va after working in a union store this store is awesome!
