Can they write you up for not staying overtime?

I work grocery night shift, as some of you may already know from earlier posts.  Can they write me up for leaving right when the schedule says at 8:30, instead of staying overtime to finish stocking/conditioning?  Can I do this during the holidays when we get f**ked with a huge load?

No, but they can make your job hell if you're an ass about it. Hell you get paid time and a half for staying over, so why not?

No, as U-boat said. As long as you cleaned up first, it shouldn't be an issue. But if you left stock and cardboard out on the floor, don't do that. If it's going to be a regular occurrence, take the precautionary step by telling your grocery manager that you won't be able to stay late. No need to make your life harder than necessary.

 

It's the grocery managers job to make sure things are prioritized when hours aren't sufficient.  He should be going around asking of you can stay late and/or telling you what to do to adhere to those priorities.   

 

For example, our store manager is very particular about conditioning.   He'd rather you condition for that last hour of your shift instead of stock.   Every store will be different.

No. If they write you up then they're dumb. You always stay until whatever time the schedule says unless told differently. If the schedule says 8:30, you can leave at 8:30. They can't hold you longer unless they pay you overtime if you have 8 hours in for that shift.

If it were me and I was asked to stay I would stay and get the job done.  If you have to be somewhere just say I would like to but.....and if you don't want to stay say I would like to but.......

 I do not know where everyone else works but in Mi, Yes.

Per my contract  876-1, this is my understanding:

The manager can tell you to stay up to 2 hours mandatory if they tell you 1 hour before the end of your shift.  If you leave before the two hours, you just abandoned(quit) your job.    I have been hearing rumors that the last contract allows them to tell you 5 minutes before the end of the shift.  Most store managers won't force people to stay unless it is an emergency.

 

 

The best person to ask is your shop steward.

Ask how much warning they need to give you.

Ask how many hours can they make you stay.

Ask what will happen if you refuse.

At my store, with me at least they need to tell me at least 3 HOURS before I get off. 1 hour is iffy, 30 min will get a 30% chance yes 70% No. And 5 min will ALWAYS earn a No. But I don't have to worry because management ALWAYS asks way in advance

 That sounds really shady.   People have lives outside of work and plan according to their work schedules.   Lots of night crew people have day jobs that they need to get to right after work.   Not to mention families sharing cars.   There's a multitude of reasons why forcing someone outside of a set schedule should not be allowed.  If that is truly the way it is, that union is complete trash.

 In the last 6 years I have been at this store, I have only seen it happen once.  Cashiers and other clerks were mandated to stay and rebuild endcaps for Christmas sales.  I don't think it took them more than an hour.

I just heard a rumor the other day that Kroger isn't forcing part timers to work 6 days at my store anymore.  They want everyone to have two days off.  It was my old timer night department manager that liked to schedule part timers 28- hours spread over 6 days a week.  

I like the OT so I don't need to be mandated to work a 14 hour day!   :)

I was pretty bad at saying no before I came to Kroger. But day after day of being asked to stay and I've gotten pretty good at it! The answer is always no.

Where I am at they can not force you to come in early or on your day off but they can force you to stay up to 2 hours past your scheduled shift as long as it's not an 8 hr shift. At 8 hrs they are usually shoving you out the door. I've never heard of forcing someone to stay over 8, only asking them in a dire emergency. I have not heard of them being required to tell you before a certain time though. In fact, that is why many people I know (I've been guilty of it once or twice) sneak out at the end of their shift instead of announcing that they are leaving because they don't want to have to stay.

Yeah I work 8 hour shifts, a 40 hour week. Midnight to 8:30. They made us stay a 13 hour shift until 1pm one day so that we could Key Refail condition every isle for the "higher up" grocery manager. After that I wanted to kill myself. We are understaffed on nightcrew which is why they expect us to keep staying. But I am going to test the waters on this and never stay after 8:30am no matter what they say, whether the load and conditioning is done or not. "It's 8:30, my shift is done, I will clean my cart, then I am going home." We'll see how it works out in a few months and if I get written up or fired for it, I'll post about it. I'm willing to lose my job over this, there's better jobs in town anyway.

I've been with Kroger for over 20 years, and earlier on I got asked to stay a lot, for a while I averaged almost 20 hours OT per week. But that was a long time ago, now it's rare for me to get even an hour OT, they simply don't ask me to stay anymore. Granted, the fact I make more now than I did then probably has a lot to do with it. But honestly, I don't miss it. Most days when my shift is over, I'm out the door. At any rate our contract here states they can request we stay, at least 2 hours before end of shift but it's just that, a request, and we can decline.

Just a follow up, I talked to my night foreman today about this. After some hard weeks work of getting on his good side, he finally opened up and told me the truth, "We can never force you to stay OT, we can only ask. You are always allowed to go home at the end of your scheduled shift. You just have to clean up, then let us know if you're leaving."

I just got written up because of this and I never knew this the 10 years I worked for Kroger on and off. I sadly work in MI. I could be fired at the drop of the hat now because of not staying over an hour.

 Same here in WI. Although ours are worded in that management MUST ask / request before the 1 hour deadline hits. After that request though, if you say yes, the two hours become part of your shift (aka mandatory)

The OP should count them self as lucky to have OT available. We were given a memo a few weeks back telling us that nobody will get any OT - No Way- No how - You will be written up and or fired. now, along with the extra work load we have to take hours off of the back end (end of week) if we work longer on any particular day because of,,,,, Well,,,,, call outs, simpleton coworkers, lazy F's, and that one that doesn't start her shift right on time (20 minutes late) because she has to prepare for work/bathroom break/etc.. after she clocks in........  ARGH!
