Our store has a MASSIVE Dairy department. It takes 5 full timers and 3 part timers to run it. Today, we're running it with 3 ft and 2 pt. Our "Grandfathered I'm above everyone else in the store" dairy manager is a bundle of joy to work for. He's also our union steward and when he says there's overtime work available in our dept, it must be worked. I happen to be a part timer working about 46 hours a week, 4 full closings including cooler breakdown. I never leave on time frankly because our stores always busy and our store is a focus store in the division because we are so understaffed. I'm never allowed to go home until I'm finished because if the cooler isn't broken down and our entire dept isn't conditioned I'm taken to the backroom and screamed at until the dairy manager is blue in the face. All the work is being passed on to me because the new part timer we've had for a month does half the work we can in the same amount of time and has the gull to ask for the 4th off so "he can enjoy time with family and friends" within his 45 day window where two AM people work an 800 piece order while I come in mid day to start my share of the order and closing again. Eschedule only allotted 24 hours to be worked on the 4th. I ask for more daytime hours and shorter shifts and next week got scheduled 5 days in a row for 8 (10) hour nights.

Given that background, what would you do: Switch depts, transfer, or quit?

I would only choose option 3 if you've been with the company for less than a year.  If you like working in dairy, I would go to another store and ask if there's an opening.  If you like the store you work at, then see about transfering to another department.

well i would say go to the union....but yea i would still go to the union. Go over his ugly ass face and call em. He can't keep you past your posted schedule and he knows that.

Reading this pissed me off so I would wait till a huge day when he was there (preferably alone). Then just tell him, hey man, **** YOU I QUIT.

That would be so satisfying.

But yeah I would try to transfer departments but i doubt management would let you if they are short staff in dairy.

There are normally 2 different languages in the union contracts that I have seen about forced overtime.

1) You voluntarily accept staying over and you can not be forced to work past your scheduled time [I know that Local 400 has this language]
2) You can be forced to stay under "needs of the business" as long as you are told a minimum of 2 hours before the end of your shift and you HAVE to stay.

You'll need to find out which one your contract says before making your next move. If you're planning to tell your department head to screw off - I wouldn't ask him. If you have to ask him anything just ask for a copy of your contract and do not go into any detail. I'd probably just say something along the lines of "reasons", or "I would just like to read up on it".

Dairy is ridiculously understaffed everywhere and hard work. I would find a new job or transfer, the union will just yank your chain till you have had enough and quit anyways.

Doesn't sound much like a defender/representative of the workers, does he.  Is there at least one other steward in the store?

Yes: touch base with your business agent.  If there's no satisfaction there, work your way up.  "Compromised", "conflict of interest", and "potential failure to represent" are terms you might use.
