Tired of having to ask for a break

So I work at a smaller store linked to Kroger and I am about tired of the break situation. Its like they completely forgot about your breaks and you constantly have to ask otherwise I won't get a break. And I am the only one. Nearly all the employees are told to go on a break and I just get forgotten about. I am tired of having to ask. Today I worked an 8 hour shift, 8-4. I was cashier, the only one as we are a small store and we have only 4 cash registers. Its 1 and I was tired and I was starving and I had not had a single break. So I finally asked my manager if I could go on lunch and he's like one of our other employee hasn't had her lunch yet and I had to wait until she has had hers so she can take over the register once she is back on the clock. However she wasn't taking her lunch yet until she was finished with something else. It was 2 almost until I finally got a break. How long into an 8 hour shift do you normally get your lunch? Cause for me that is way too long. I can't work properly if I am starving to death.

They should have allowed you to take your break if the other person was refusing to take theirs. Just because they have seniority over you doesn't mean they HAVE to take a break before you. it's stupid to make you wait while they are just lollygagging around.

I always have to ask for my breaks, as well, but when I do I normally take into account the status of the other employees and can take my breaks when I ask for them. /shrug

My contract states breaks have to be given between 4 to 6 hours of work.  I used to work early at 6 am and trust me I didn't eat before having to be at work that early!  Coffee and go!  I sometimes had to wait until noon or 1:00 before I got a break.  So I would get my 30 minute break, then work and hour and go home.  Normally though another cashier would come in at 10 and I would get my break about 10:30 or 11:00.

 

Try to eat something right before 8:00 if you can.  Something healthy not sugary that will make you crash later.  Good luck!

 Well, if it wasn't based on her seniority then it was based on the time she came into work. She was doing something else at the time and couldn't take the OP off, but the manager said that the other employee had to take their lunch first before the OP could take it.

So, the other person was lollygagging around and not able to let the OP go to his lunch, she didn't want to take it either so the OP was just S.O.L. until the other person finished their lunch break.

I don't know why you think I'm unable to understand the post, but if you want to enlighten me... by all means. 0.o\

As others have stated, check your contract, ours does list when lunches should be given (though 15 minute breaks are at a supervisor's discretion I think). I find it troubling that you seem to be the only one getting late lunches, ask the supervisor, or go above their head, to see why this is going on, if someone just plain doesn't like you (harassment) or if it's a seniority issue or what.

I can tell you at our store, you would have gotten a 15 minute break between 10 and 11, and a lunch between 1 and 2. But like I said, a LOT of it differs between stores and districts.

go to your store manager and tell him that the store is breaking laws for not giving you a break/lunch ontime (our store its 2 breaks and a lunch for a 8 1/2 hr shift) if they are like hahha, just go to your union stewardess and file a grievance.

our CSM is HORRIBLE with breaks but all the other supervisors are great unless someone takes a 30 min break or a hour long lunch then it effs them up.

Reminds me of a few years back.. we used to have these two girls working in the deli and they hated taking their break at a reasonable time. But they would get so pissed if I tried to go before them. ("Well, we didn't get our breaks yet so why do you get to take yours before us?") I usually ended up going anyway. I didn't like those girls and they didn't like me... I was so happy when they were fired.

haha yeah tell your boss that not getting a break is against the law...then no hours next week or you will be bagging every 5 minutes up front...

Depends on the state and the union contract.  My contract allows for a break however, my state does not.  So you can work 8 to 10 hour days in my state with no break and the state doesn't care.  However, any decent employer will allow them, but it is up to the employer.

I feel bad for you. I think it's time to find a better job.

At my store, you're "supposed" to get two 15-m breaks if you work a 5.5-8hr shift. Minors also get an unpaid lunch. Break usually comes within 2-2.25 hours of your start time. 

My store is usually good at giving people both breaks. Sometimes I do breaks and make sure they're on time or as close as possible (e.g. one person coming back late screws it up) but some nights people only get one break. Last night I worked 7.25 hours and was entitled to 2 breaks but never got the second one. I usually don't give a crap unless it's very busy and I *need* a break before I screw up or faint or something.

My store's pretty good about breaks, but sometimes I get pissed and say what's up, like one time it had been 3.5 hours since I started working and no break.

I would never skip one of my breaks, even if I only had 15 minutes left in my shift. You're entitled to both of them.

I've had to do that before.  Made me mad.  I had to hang around for 15 minutes, then go clock out.  Some break.  It's nice some of you get more than one break.  We get either 15 minutes or 30 minutes.  Our contract says you can split the 30 minute break into two 15 minute breaks but they never let you do it.  It's hard enough to get any break.

When it's my time for break and they are being *******s about giving it to me I go into 'hiding' for my alloted time. Hey, if they are not going to give me my break, I'll take it upon myself and give it to myself.

 Are you still working night crew? in my store, night crew takes a break at a scheduled time so everyone gets a break. it's not like there's many customers needing assistance at 3am... smile

They have me working days for now. One guy quit and they had no one to help work his dept so they chose me. Hope they find someone soon because I prefer working my original shift. No one really in the store at that time meaning I can't be pulled to do other tasks that are not my responsability and not having to stop to deal with crazy customers.

This crazy new shift throws off my breaktimes. That's why I go into hiding to get my breaks that I am allowed to have
