I would like to make a formal complaint regarding the scheduling of the Deli Department.  We have had a change in management and I have the most seniority in the entire department but I am being put on 4 nights out of the 5 nights I am scheduled to work.  I am aware of the new contract (my husband has 3 degrees in law and is wanting information prior to proceeding)  and the new contract states that seniority can be a factor if an employee has a concern with working the night hours.  How do I proceed?  Do I just contact my union representative and have everything done through my rep?

Does new management know of your seniority? I'd talk to them first before going forward. Because if you go above management before talking, you may be in for a bad time.

What is your availability?  Are you part time or full time?  Is there a reason other people with less seniority can't work nights?  You might have to to greatpeople.me and change your availability.  If you say you're available 12PM to 9PM and someone else says they're available 10AM to 9PM, E-Schedule is going to schedule the second person with earlier hours.  They might get 10AM-4PM while you get 3PM-9PM.  You either need to change the time you can come in on certain days or the latest time you are willing to stay on certain days.   If you have open availabilty, then you need to get with your deli supervisor/leader/manager and explain you want earlier hours.

 once you make an availability, I believe you lose all seniority "rights" for that/those days.  I could be wrong, however.  "most seniority" are you the dept head?  or did you get overlooked for that position?  I know it does happen that someone who isn't dept head can have more seniority, but I often wonder why that happens.
