The "background check" goes on as long as you live. They would sell your organs until you die if they could keep it secret. One rule: who makes the rules wins.
Some other employer finds kroger in your resume will think you're a criminal, so in the long run you will be better off.

You can do what ever drugs you want in your free tme but unless you have a dr's note stating allow to use you're pretty much screwed. Tis the fun of living in a state where it's legal but in drug free zones you can yes be fired for possession or use.

OP says he was working for 3 weeks. That is still probationary period. They can fire him for something as small as the pitch of a fart or if a hair is out of place.
OP must be in a marijuana free state because he said he had a marijuana charge. EVEN if the state is now marijuana friendly, most jobs are not. EVEN WITH a doctors note they may not allow it.

You can do what ever drugs off the clock you want but if you're found in possession of an illegal drug then yes you can be terminated due to a zero tolerance policy.
