Well... I/we may end up suing kroger because they hired in a drunken lead and management is too lenient about it. Only until we started filing massive complaints did they actually start to do something about it. I can't get my manager on what I'd like to get them on. The little slime. But I can get them on harassment because they know our lead has been harassing us for months, are very aware of the situation and refuse to do anything about it. Finally after years of enduring nuisance harassment from odd ends I have them officially on something. We're documenting it so they can't turn a blind eye to it.

No you cant sue that discrimination and instead you will be counter sued. But hey FAFO
Physical abuse contains the definition of harassment in forms of berating, cussing, swearing, threatening....
We're documenting everything now as we're sick of our lead being a drunk mean sob. Management protection lasts only when the current manager is there. Once they're gone that protection is gone. No one is above the law.
As we have begun to document everything if this turns into a year or so case -- yes we are suing.
If you can defend youself, the company acts innocent and orders everyone to monitor for "attitude". If you cannot defend yourself, they beat you down into slavery.
