 Sometimes you just get people in there whom don't like you for no reason. I had a guy come in who didn't like me at all. He would expect me to do a 3rd cut, wrap it, wait on customers, fill up the counter, break down meat & seafood, condition lunchmeat and frozen, break down the truck, and be out by 10 pm and if I didn't he would have a **** fit. He would expect all this on a saturday and im from a mainstream store.

Anyways... in our union contract a department head must rotate the schedule from time the time. You can bump a person if you do have higher seniority, but you must be careful. In doing so you can create enemies and stir up trouble.

Hello. I work Night Stock in grocery department. My department head threatened to make me do replenisher duty (which means work daytime stock 12-8.)

If he does thiss though, can I just claim someone else's schedule below me in seniority as long as they know how to replenish as well?

 

My wife goes to work usually anywhere between 12 to 2 and is there from 4 to 6. I have to be home at that time to watch my son. My wife doesn't trust daycare or anyone else to watch him.

 

please help me. Is there a way to stop the department head from doing this? He is threatening me because he does not like me.

The local union reps in my store are not exactly all that knowledgable. I've looked within the union contract handbook but there isn't anything about seniority and bumping in it, but I do know that you can bump hours from someone below you in seniority, even if they have less hours than you, as long as the shift you take doesn't put you over 40 hours.


Example:


Let's say Dave has more seniority than Jeff. Dave only has 30 hours for the week, as does Jeff. Jeff works 8 hours monday. Dave is off Monday. Dave can take Jeff's monday for himself.

 

I have seen ppl on this forum say that you can not only do that, but also bump entire SCHEDULES!

 

How do I find out if this is in my contract too?

No, I am one of the best workers we have on night stock. I am one of the fastest at facing and running cases. I do as I am told and hardly ever ask for anything or bother the department head.

 

recently he made a change in the aisles we were all assigned. He gave me catfood, dogfood, toilet paper, paper towels, and diapers/baby food. We have a very large store, and all of those aisles combined is ALOT more than what everyone else on the crew was assigned. So I approached him and said I felt that what he gave me was a little much for one person.

 

He went off on me, saying that I could handle it and that it wasn't that much, got very loud right there on the sales floor. I felt disrespected adn embarrassed so I cut him off and said "Listen boy, you don't want to do this here. If you are going to yell at me, we better go to the manager's office."

 

He replied with "If you call me boy again, you will be replenishing next week."

Angry and spited at his threat, I replied with "Boy, you can't threaten somoeone like that with retaliation."

He said "Don't worry about the aisles anymore-you're a clerk and that means I can make you replenish, which you're gonna do from now on."

 

That's exactly how it went.

If that's the type of attitude you were giving then you outright deserve that duty. I could understand if you were being respectful. I would apologize to him and see if you could try getting your nights back.

I was disrespectful only because he was disrespectful to me first. I don't pay my union dues for nothing, I do not have to put up with threats and being yelled at and disrespected like that.

 

had he been respectful to me, I woud have been the same to him. it goes both ways, whether you're a department head or clerk, you treat others with respect or expect none in return.

 

i went to union and management. they both said he couldn't do it that he would be acting out of retaliation and that was against contract regulations.

i win!!

I have noticed already in my 5 months at kroger that reporting a dept. head to management doesn't work....at least at my store. Good luck.

In Indiana, grandfathered employees are entitled to day dumping. Meaning they dont have to take the entire week.  Employees who are NOT grandfather have to take by a week basis.

 If you have more seniority than another employee you are entitled to their hours provided you can do the work.  Also in the contract is a perference of shift.

never advise what again? if a manager or department head isn't willing to show you respect, why then shoul you show them respect? dont let them walk all over your rights as an employee, and yes, we have the right to be treated with respect.

 

i stood up to my department head-and i won. i got him into trouble. he came to me and shook my hand and said he wanted to act like it never happened.

 

dont be afraid to stand up for yourself.
