Check your contract. From every contract I've seen, as long as you've worked there 36 months or more, you get holiday pay for New Years, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Xmas Eve. Full timers get 8 hours, part timers get 4, regardless of whether they work on that day, as long as you don't call off your scheduled shifts the day before, day of, or day after (or you provide valid medical excuse). And you still receive it if you are on vacation that week. Employees grandfathered under older contracts may be eligible for other benefits, such as overtime. And your contract may differ. So check your contract.

I'm a part timer been there less than a year and I got holiday pay for the 4th of July, so I'm assuming I will get time and a half for working on Labor Day.

Well you guys are sitting pretty. However, in the midsouth division, the holiday pay was taken out of the contract in the late 90's.

So, even though I've been with the company over 5 years, I never get holiday pay and I can only get overtime 1 way: go over 40 hours in a week.

Well, I've been in the Mid South Division for over 20 years and while I've never gotten time and half for working on a holiday, I still get paid an extra 8 hours holiday pay.  The work week for full time people during a holiday is 32 hours.  Anything over 32 is overtime.  Part time people get paid 4 hours holiday pay if they work 30 hours or less, and get paid 6 hours holiday pay if they work over 30 hours.  Only people who were hired before September 26, 1987 get paid time and a half if they work on the holiday.

If a store isn't union, it's a "right to work" state and the the union is obligated to represent you anyways.  Allegedly.

Union contracts are borderline secret.

The store doesn't want you to know your rights.

The exciting part is that the union doesn't want you to either.  Otherwise, they'd have to represent you.  Allegedly.  Not that they would.

Try to look it up.  It should be publicly accessible, right?

Yeah.
