OK, so I worked doing salad bar and cut fruit. Salad bar was moved to a new store. So the cut fruit/salad bar hours were cut. I continued in the produce dept. But now that the hours for cut fruit has been cut back the lady doing that wants my hours in produce. She has seniority over me but I feel it unfair since I have done nothing wrong that I should loose my spot. So, Im not sure how management is going to handle this. She called the union to complain because I had more hours than she did. I read the contract and Its worded kinda funny because technically the hours are not available as I had them. She cannot handle the heavy lifting in produce for sure.. Im not sure how to handle it. Im ready to look for another job..

Here is a general rule for the seniority.

If the person you are referring to has her position lost, Then she can claim your hours if two things can be reached and sustained. If her availability to do the task is not restricted and can work the hours needed, then that is one.

If she is capable of doing the job or tasks required, for the job , then that is two.

She can then claim your time and drop you to part time.

This is how it works. Two people with the same ability and availability, then the more senior person gets the hours.

They may ask you to transfer to another store to maintain your time or can work you in other departments ( excluding meats for most contracts ) to help you maintain your hours.

And that's why this whole system is bull shiit. A chain smoking 55 yr. old alcoholic who calls off all the time and never works when they are there can have stronger job security than some body who hits the ground running, is smart, fast, and wants to advance themselves by doing a good job.

Exactly!!! This is why I'm not a fan of the union, work should not only be senoirty based, but my merit should earn me more than a lazy person whos been there 5 years. I work harder, and am capable of more yet they can claim my hours....

Who would certify these "merits"? Management doesn't exactly know who works hard and who doesn't. These "merits" would be based on how went you bend on your knees and how much dick you can shove in your mouth without gagging.
