HELP FAST!!! Screwed out of full time status??

So this week was my 12th straight week of working 35 or more hours. This week I was scheduled 32 hours. They needed help a couple days earlier in the week, so I willingly stayed after with the rest of the night crew, enough to where I started last night with enough hours to get over 35 for the week.. Out of no where a manager who was in the store during the night calls me upstairs and says the store manager has asked me to end my shift early and to go clock out and go home. Then stated if I failed to do so it would be insubordination and I would be terminated... Can they really do this to me? They also made everyone else, even people I have been there longer than AND didn't show up last night, on shift have 40 hours which I mentioned to a manager whom apparently did nothing about it.

If you were scheduled those hours then you work your schedule. Call your union rep.

That's what I thought. I asked him six or seven times if he was allowed to do this and he said, "Yes, you've already worked as many hours as you were scheduled this week so please clock out and go home." I really appreciate your help. Our Union stewards are in the manager's pocket so I have to wait for the main office to open in 45 minutes.

Can someone tell me exactly where in the contract my issue is? Or where I could find the current contract and read it myself. I need verification.

 Now there is one thing you have to do is this. CHECK YOUR CONTRACT FIRST. Before posting you may want to state you location and under what contract.If you are under local540 in the Dallas area, then consider this . It is not being scheduled 35 hours a week but AVERAGING 35 HOURS A WEEK WORKED!!!!!!!!!!!!!!!!!!!!

Lets say you worked 35 hours for 10 weeks and one week you had 38 hours. Now they place you at 32 hours and work only the 32. Now you have 12 weeks that average 35 hours a week. That will qualofy you for full time. I have caught a lot of flack from having a part timer getting an extra hour or two here and there to average the time he needs to get full time.

Now if your contract states that you have to be schedled 35 hours a week then you need to have your local change that when your contract comes up the next time around.

Call union if you where called in and their is still work the cannot tell you to go home because they agreed to let you work. They don't want you to get full time but fight it.

I'm under the Local400. I'm not sure where to find a current copy of the contract, thus the reason for my last post. Thanks for the input.

 Your shop steward should have a copy of it. Other than that , contact your union rep and demand a copy of it. ASk them also ( while demanding a copy) for the specific article that states hours needed ( scheduled or averaged) to qualify for full time status.

My understanding is under the Local 400 contract that if a person averages a set amount of hours over 12 weeks a full time position is to be posted and to go to the most senior person in the zone who signs it.

In most union contracts it states an employee will not be required to cut hours because of being asked to stay on a previous shift. File a greivance with the union you'll get it.
