Scheduled 41 hours with one day off?

So, my last day off this week was last Sunday. Looked at the new schedule today and I work Sunday through Wednesday which means I'd be working 9 days straight. I was also scheduled 41 hours with just Wednesday off. How can they schedule someone 41 hours in a week? I also work at a store in Kentucky.

You can be scheduled any # of hours they want, but they have to pay you overtime for anything over 40 hrs. Their choice. The contract says nothing about days worked in a row afaik. It does, however say that if you work more than 6 days in a week you must be paid overtime for any hours worked on the 7th day. 6 days is fine, tho.

Basically, it's your own fault. There's an easy solution though to keep this from happening again. Request days off apart from each other in the same week. This should give you some much needed breathing room.

I've done that but they also deny those all the time. Right now, I get good hours because I have anytime availability. I don't want to put in unavailable days because I know they'd schedule me ****ty hours after that. We have bitter front end management. God forbid that you want two days off during the week. I'm not going to stop putting in requests though. I've already filled one out for the next schedule. I had to go to the store manager to actually get my 9 days in a row fixed because our union contract states that you can't schedule within a two week period 7 days in a row. Next time it happens, I'm going to go straight to the union. It happens all the time.

I also wanted to say that our management want to keep everyone part time from getting full time status so they avoid things like scheduling us more than 30 hours a week (I'm part time.) and not giving us overtime so this is just a little weird.

duckmoose, I might ask what department you are in. This nonsense can happen easily in some departments, or is asinine in others. I approve of your solution of using the union, you gotta be giving the money for something.

The contract does say that associates are to be given two days off each week. and 6th day work is overtime, once you clock in on day 6 for the week it's OT.

No it doesn't. At least not in local 1995, which may cover the part of kentucky duckmoose works in. It says that for full time employees, but that is pretty much implied anyways. It says nothing about working 6 days for part time. I know for a fact we can work 6 days with no overtime.

You have to check your contract.   I am a part time employee.    My contract says I get one day off during the scheduled week.  They can schedule me 28(october new contract goal) hours for 6 days.  If I work all 7 days in a scheduled week, I get overtime for those hours on the 7th day.  Anything over 40 hours is overtime per Federal law.  It is different for fulltime employees.  They get 2 days off a week but already gauranteed/have 40 hours a week.

When I get back from my vacation, I usually get scheduled for 12 days in a row.   1st day of schedule back and last day of second week I get scheduled off.
