Working a sixth day
Permalink

Our contract says that you get paid time and a half on the sixth day but only if you work six CONSECUTIVE days in a week.  Does it matter if you are full time ?  I thought working on a sixth day would be overtime whether it was consecutive or not since you are working over 40 hours.  I am confused.

Depends on your contract.

Are you full-time or part-time?

Per our contract:

Anything after 40 hours in a week is OT per Federal laws.

If you are full-time, 6th day is OT, consecutive or not.

If you are part-time, 6th day is not OT unless you are over 40 hours.

I am normally scheduled 31 hours in 6 days and do not get OT for the 6th day because I am part-time.  Actually, last week was the first time I can remember in the last 4 years that I was scheduled 31 hours in 5 days.  It was nice having 2 days off during the week.

6 days in a row is not how it is calculated.  It is 6 days out of the 7 days in your scheduled week.  My workweek goes from Saturday to Friday.  I can have Saturday off, then they can schedule me Sun, Mon, Tue, Wed, Thurs, Fri, Sat, Sun, Mon, Tue, Wed, Thurs and it would not be OT for me.  And, yes, my manager does this to me when I come back from vacation.

In my contract, 6th day is OT for all employees and the word "consecutive" is NOT used.

If you are called in on your day off to work, and you are scheduled 5 other days in the work week. That call in day will count as your ""6th"" day. Make sure you work 8 hours too! I learned this the hard way years back.   Hopefully this makes sense.

They've tried getting us to work only a halfday, but we made it clear years ago that if we're called into work on our off day its either 8 hours of overtime or no overtime period.
