I wasnt terminated yet. but sure as hell positive i will be. i took some food to the break room before i clocked in and thought i could just do the 2 minute walk home and get the money and come back scan it and im fine. i see customers eating the food all the time in the store so i thought it'd be fine. as long as i had the intention of paying. but i guess not... im currently suspended pending investigation. guessing im terminated huh?
I'd say you are done. Someone either saw you and ratted you out, or management saw you themselves. It's hard (impossible) to prove that you had the intentions of paying. Looks like you're gone, unless they decide to be generous (VERY rare) and give you a second chance. IF they do, consider it lesson learned and not do it again.
Eating before paying is stealing. It's in the company policy that you signed when you were hired. Loss prevention can and have busted customers for eating while in the store.

Kroger has no way of knowing if you are actually gong to pay. It's your word against there's and unfortunately their word rules in this scenario. Usually any business goes anal about that kind of thing... Hell if they we're lenient, I'd grab a laptop, leave, and say I'm gonna e back later to pay....

Well, that's your problem right there.
If you ran a store and spot people walking away with food without paying for them, wouldn't you stop them? How likely are you to believe that they'll "pay for it" later?
You're not a customer. A customer can get away with that because the store doesn't want to lose their business. Even though they've opened and ate a product, normally they've got a ****load of groceries that they're pushing around. You're an employee.
Now, do you see any of your service department people (deli, bakery, produce, meat) take product from their shelves or even their backrooms and eat them at the break room and intend on "paying later"?
Sure, you may have intended to pay, but how will you prove that? Climb and face a surveillance camera and talk to it, saying that you'll pay for it? Leave an "iou" at the spot where you got it from? Yeah... no. It doesn't work like that.
I'm sure you'll be fired. Best of luck finding a new job. Hope they don't ask about why you've been terminated or "voluntarily quit".

Did you actually open the food before paying for it? Also, did you take the food out of the store before paying for it? If the answers to both those questions is no then you may have a shot at keeping your job.
