EEOC is very hard to prove. Can you tell us why you might think they are violating EEOC?

The U.S. Equal Employment Opportunity Commission (EEOC) is a federal law enforcement agency, that enforces laws against workplace discrimination. DIAGNOSED WITH SOMETHING WOULDNT TAKE MY NOTE AND TOLD ME NOT TO COME BACK,, MEDICAL DISCRIMINATION, VIOLATES EEOC, THEY ARE SUPPOSED TO ACCOMODATE ME, BUT DIDNT TAKE MY NOTE TO EVEN TRY, TALKED TO UNION, CANT HAVE NOTE, MUST RETURN NO RESTRICTIONS, AKA NO ACCOMODATIONS? SO I WILL BE TERMINATED, CANNOT LIVE ON NO WAGES NOT FULL TIME AS IT IS, AND SINCE I CANT RETURN CAN I GET THEM TO PAY ME FOR UCB? OR SSD APPLICATION OR GET A LAWYER OR CALL NEWS OR ALL OF THE ABOVE, I HAVE BEEN FAITHFUL EMPLOYEE AND NEVER HAD AN ISSUE ON THE JOB, THEY ALSO STATED SINCE I DIDNT HAVE ANYTHING HAPPEN ON JOB, I PRETTY MUCH WOULD BE A LIABILITY JUST WAITING TO HAPPEN?>THANKS,

If there's anything I got out of your post, it's that your shift or caps key is stuck or broken, and/or that you're probably another one of them self-entitled pricks who try to waive around a piece of legislation and regulation even though they do not fully understand and grasp its purpose.

Maybe Harleyrider1957 is upset. He/she might have a legitimate reason to use caps. I don't know if this story is true, just like YOU DONT know if this story is true.

Call the EEOC....talk to them, they will tell you if you have a strong case especially if you can prove any age or disability discrimination. Shake them up! That is what they deserve. Years ago they would take medical notes with restrictions and accommodate the employee until the doctor restrictions were removed. Not sure what your whole story is but if you have been employed with them a while, never had an issue with them until now...fight them and the Union as much as you can. It's not easy but if you honestly feel you're being unjustly discriminated against...make that phone call.

Its my understanding that if you have an medical condition after being hired and you're not capable of doing the job thats assigned they don't have to allow restrictions if it wasn't an on the job injury/condition.

That's how I understood it too.

It might not be right, but if your job details are something you can no longer do, should you expect the company to pay you AND they have to replace you too?

 Yeah, we had a guy with heart issues and was out for a long time. They eventually had to terminate him due to his heart issues because the doctor wouldn't release him.

They aren't violating anything.

They can not hire/keep one person over another, as long as both can do the job, based solely on a disability. 

If it isn't a job related injury, they owe you nothing sadly.

we have this fat bitch in produce that is on restrictions.  she's been with kroger forever.  she can't do anything but cut fruit (and she can't even do that to be honest) yet she is guaranteed 40 hours a week while the rest of us that actually have to do all the hard work in produce are lucky to get over 25 hours to get everything done.

'Forever' is the key word. Forever=more seniority. Sadly, as long as she does her fruit cutting to where it's acceptable she has the hours. Reason I say this is because we have a guy that's been at our store since time began, who BARELY does enough to keep him hired
