hello I've been working part time for night stock and after a year of my employment my manager comes to me stating I've gotten fulltime status. I am being scheduled 32 hours but has told me I'm required to work 40 or he will take my fulltime away with the excuse of not having enough hours. Now I've been told by several other associates he cannot do this and yada yada. If I were to be scheduled 32 hours and leave on time each day is there really anyway he can take it away? I've worked too hard to throw it away but im being ridiculed about my performance on a daily basis and slandered openly when everyone else thinks I do an amazing job. I'm tired of being paid much less than my coworkers yet am expected to pick up after them and feel if I left on time for a week or two he would realize hes been in the wrong. if anyone could put some insight into this dilemma it would be greatly appreciated

What state and contract are you under?  Don't give any identifying info.

Here, you are full time or not.  Per the union contract, you are guaranteed 40 hours and 2 days off a week.  But, you have to apply and interview for bids to get hired full time. 

Speak to your union rep to get the right answer.

If you are full time, then you should be getting full time hours.  Christmas week and the week of New Year's are different because of the holidays.  Under my contract, if you were hired before a certain date, full time people are only scheduled 32 hours during a holiday week.  The remaining 8 hours are holiday pay.  If you're under that category, you get paid overtime if you work over 32 hours.  If you were hired after the cutoff date, they can schedule you up to 40 hours during a holiday week before overtime kicks in.  The people under this category still get holiday pay.  It just doesn't count towards their hours worked.  Check your contract to see what it says about holiday pay.  You might have only gotten 32 hours because it's a holiday week.  If your supervisor isn't giving you enough hours to maintain your fulltime status, then you need to speak the co-manager in charge of that department or to a union steward.

Read your handbook carefully. In my district, you must maintain an AVERAGE of 32 hours per week over each 12-week period. LOA, vacation, and proven medical absence don't count. You must also be available 24-7.

Depending on the contract, you must average 40 hours over a 12 week period. You can lose this status if your average falls below 40 hours in 12 weeks, regardless if you worked 40 hours for months or years.

 There's one coworker I hope this happens to. Show up and work all your hours stop making life hard on those of us who do.

As long as you have open availability you stay full time. You can be sent to a different department but that's it. Supervisors don't "take" it from you.

Is he just wanting to schedule you 32 hours each week and the the other 8 hours are as needed when he says he needs you?  Like staying late or coming in early when he says?  Or is he going to schedule you 40 hours each week?  If you can, take the 40 hours if it's scheduled.  Anything over that is overtime and if your store is like mine they rush you out the door so you won't get overtime.

 

If he's wanting to control your time off by making you come when called I'd think twice about it.  But that's just me.

im scheduled 32 hours 5 days. He says even though im scheduled odd numbers I am required to stay for a whole 8 hour shift. If I refuse I lose my Fulltime status because he can say he dpesnt have enough hours

 I'm not understanding this.  Why doesn't he just schedule you 8 hours each day if you have to stay and work 8 hours each day?  Do have to just look at the schedule for each day and say ok, 10 - 2, I will work until 6.  7 to 2, I will leave at 3.

 

Is anyone else in your department on the schedule for a full 40 hours?  I would just ask him if he can't just put you in for 40 hours, that way there won't be any confusion on exactly which hours you are supposed to work.  Or he can pencil it in after the schedule is printed.  I wouldn't be comfortable with a "verbal" schedule, that's in his favor and could work against you.  I'm pretty sure it's against your union contract as well.  My contract states schedules will be posted in ink with first and last name by noon on Friday.  Then you get 24 hours to adjust it, claim hours, etc.  By noon on Saturday the schedule is FINAL.  In writing.  No changes.

 Yeah, something fishy is going on there.  It looks like the department manager is trying to make it look like he's not using as many hours as he really is.   He may be trying to the hours budgeted for the OP to someone else.

Find another employee you trust and have them with you then ask about the schedule and why he isn't going to put 40 hours on it for you.  Or ask your store union steward to be present.  Also bring up where he said he would cut your hours if you didn't work fulltime. I would get this cleared up before going forward.  Just be nice and say you just want to clear things up with the schedule, you have some questions, etc.
