Overtime

I was told that I accumulated overtime and it has confused me. I came in on Tuesday at 4pm-8pm and then came in Wednesday at 3:30am-12pm. I was told that since there wasn't a 8hr gap between shifts that I should get overtime. This was told to me by coworkers and my dept manager. They told me to watch for it on next weeks check to make sure that I get it. I just want to verify that I am owed OT on here.

I'm assuming your contract is similar to mine in this situation.  You're suppose to get at least 8 hours off between shifts.  If you don't, then the difference between 8 hours and the amount of time you actually had off between shifts is overtime.  In your case, you had 7 1/2 hours off.  So you should get a half hour as overtime.

Ours is 10 hours rest time.

Just make sure if they try to make you sign something, say NO.

They screwed over a new coworker of mine. He had a 6 hour rest period and didn't know any better (was his 2nd week) and signed away his OT.

yeah I've worked lots of shifts with much shorter gaps than required under contract which is 10 hrs in Atlanta division and never once gotten OT or any thing extra for it no matter how close they were.

I personally don't understand how there is no recourse for employees treated this way. Let's be real, do I need to be coming back in six hours ever? I shouldn't.

Mine is 10 hours relief period. So if you really did only have 7.5 hours between shifts, the entire duration of the second shift will be paid as short rest pay, which is time and a half in my local.
