Our fuel center is one of the few that has a bathroom.. Thank God since we are never given breaks or lunches... I am not exeggerating, in the last year not once have I or any of my co workers been given a break or a lunch.  The other issue is we store food display carts in the bathroom at closing.. Our fuel center manual says we are not to store food in the bathroom yet we do... Management doesn't see an issue..

Wonder what your state, county, and/or municipal health codes say.

Wonder what your union contract says about no breaks?

If you are in a union, you are most likely entitled to your breaks.  If you've been working there for over 2 months, they most likely can't fire you without a really good reason (such as stealing or way too many call offs).  If these are the case, let them know that you will be taking your break and ask when they want to do it.  If they don't send someone out to cover for your break, contact the union.  They can get in trouble for that.

They can give you a hard time for taking your breaks.  Managers treat different people differently.  If you do this, they probably won't like you.  They still can't fire you for it.

Plus, if they give you problems, you are witnessing some sort of health code violation.  Wouldn't it suck for them if the health department found out about it?

No, I'm not new to Kroger.

Are they paying you for all of the hours you work or deducting a 15 or 30 minute break from your paycheck?  If they aren't paying you for ALL of the time I would file a grievance for back pay and insist they give all employees working in the fuel center a break.  Employees inside the store get a break so should you.

As far as storing things in the bathroom I'd report it.
