I keep getting a bill and phone calls for an injury that happened a year and a half ago.  I fell while helping a courtesy clerk bring in buggies and suffered a concussion.  It happened on a Holiday weekend.  When I went back in the store and talked to the manager, when she asked me how I was, I told her I thought I was okay, just shakened and I would just dust myself off, rest a second and go back to work.  Well, the next day my face was swollen, my left eye was swollen so bad I couldn't see out of it, but everyone knows how a Holiday weekend is and you don't call in! I went to work anyway and everyone (except management) told me to go to the Dr.  I went on Monday, they ordered a CT and was sent home, told to rest and do nothing.  No TV, no computer, no phone, nothing but rest!  The manager was mad!  The co faxed a sheet to the DR and told them they weren't responsible because I didn't report it until 24 hours later!

I actually have pictures and more than enough people who were there and saw me.  So who do I need to contact?  They are messing with my credit rating!  Any suggestions?  I keep giving the ASP the bills and she says she is sending them in.

First: I truly hope you are all better now, and with no lingering injuries and/or disabilities from that. But second............

You probably are screwed on this. Although I completely understand and applaud your work ethic, you ALWAYS stop the whole show and get medical attention after a work site injury/incident. It's all about liability now----and after this, Kroger can wash their hands of you. Most places will fire you for refusing medical attention, by the way.

As for recourse? You'd have to seek out an attorney and sue in civil court.

 Did you go to a company doctor or talk to anyone at Kroger and get a claim number?  If not, then they aren't going to help you.  You could talk to an attorney.  I'm pretty sure Kroger would have been responsible even if it was 24 hours later but you should have had the them take care of the bills a long time ago.

I never refused medical treatment, I said I think I'm ok.  People with concussions aren't known to think straight.  You could tell by looking at me I was hurt.  The fall knocking me out should have been our first clue.  I just wanted to avoid all the grief they gave me for getting hurt.

Welcome to Kroger.
This company could give a sh!t.

 

I always said-- and still do --that if you died, Kroger would demand a death certificate from your family, and write you up for tardiness or no-show if one was not provided.

I was hurt on the job.  I told my manager and they just blew me off.  My injury got worse so I reported it to the store manager.  I ended up going to the doctor 7 days later.  But I reported it to management.  That's what you have to do.  They don't know if you fell again when you left work, etc.  The only thing to do now I guess is talk to an attorney and let them know you have several witnesses and tried to talk to management.  That 24 hour reporting is BS, that's not in writing anywhere so how would you have known?

I think the 24 hours reporting is because their in-store security cameras and footage saved.
I'm not sure what a typical Kroger saves for footage.
I was given the impression it's at least a week.

But if a customer is injured, the cameras can show what happened.

 Then they need put that in writing in the employee manual or the union contract.  "Please be injured in full view of the security cameras and report injury within 24 hours so we can save the footage".  Now you see why .......it's not in writing!
