Questions about closing and staying passed
Permalink

noAm I required to stay passed my scheduled 4 to 8 shift when closing in bakery if all the perishables are bagged and tagged already so nothing goes to waste. My closing manager keeps making me stay till everything is done including mopping and sweeping and my Bakers store. When I worked at Ralphs before transferring to bakers my old store didn't like over time so anything we didn't finish we would leave for the next morning but now that I've moved to another state and transferred to bakers my one closing manager makes me stay till everything is finished so the latest I've stayed past my scheduled shift was 12:30 am and I no its not appropriate. I know laws differ from state to state so do I have to stay passed 8 like my boss says or do I have the right to clock out at 8 pm midnight. Bakery closers work by their selves they don't get a part to help close like deli does. I transferred from store in California to store in Nebraska. Please help

Depends on your contract.

My contract says a Department and Store manager can insist(force) you stay 2 hours over your shift but they have to give you notice an hour before the end of your shift.  If the store manager wants to be nasty about it, they can fire you for job abandonment.

I imagine everything needs to be done before they open in the morning.  It could be you are not getting enough done.  Are you being given too much to do?  Let the department/store manager know.  Is your time being spent well?  Be prepared to show where your time goes.

I am a department manager.  My pt employees are always complaining about not getting enough hours.  I do not like forcing anyone to stay over unless it is absolutely necessary.  I have to practically beg them to stay an extra 2 hours.  Or, they turn me down if I offer them extra hours ahead of time.  Then, I have to use the slower people to get the work done.  Then, they consistently call in and lose hours.

See? I'm right on every one of these advices I give.

Most of the contracts are different from region to region.  I could skip the "read your contract" and just state what my contract says.  90% of the time it would be wrong info.  California has special state laws.  Let's say I make $19 an hour.  A person with same job probably makes $25/hr in California and $12/hr in Texas.  So, the person should always know their contract or ask their shop steward.

In Cincinnati/Dayton area, contract says management can hold you over 1 hour, but they have to inform you they are holding you over at a minimum 2 hours before the scheduled end of your shift.  But at my store this never happens because no overtime is allowed for any reason - no exceptions, period.  So, whatever work doesn't get done, simply doesn't get done, and is left for the next day.  Then of course management asks, "why wasn't the work done yesterday?"  If you tell them because of lack of help/hours, according to management that is no excuse.  They tell us to get the work done, or they threaten to take away even more hours from our department.  Common sense would tell most people that this only punishes the customers because the customers have to wait longer for help.

That's how it was at my old store before I transferred but now theirs way more to do and I don't feel like I get enough public communication with a lot of customers now because I'm trying to package everything as quickly as possible and only get to say hi to to customer who come up to the cake case. i know my manager gets annoyed that things aren't done exactly by 8 to 830 and I've told him its not enough time that finally I got annoyed and informed him the truth that I don't take breaks and if I ever do it's only because I got the one 8 hour shift on my schedule compared to all my 4 hour shifts so I'm required to take a lunch. If I am able too, how do I get a hold of my contract?

Ask your union steward for a copy or call your union rep, they will get you a copy of your contract (they're supposed to if you ask for it).

Don't skip breaks.

Take atleast a 10 minute break but don't skip the 15 minute break all together.
