Clashing over availabilty
Permalink

When I joined Kroger, my availability was limited to certain days/times due to other obligations.  This was approved by management and I have had no issue until recently.  We have a new FES and she's continually tried to schedule me outside of my availability as well as called me multiple times to come in on days I'm unavailable.  Recently she has begun threatening me with little hours (my next week only has 4) or not scheduling me at all.  Then today she told me she's going to recommend I be let go because I won't work the days she needs me for.

I don't know if this is worth fighting.  I haven't had any issues or complaints from the male FES or any of the store managers about my availability.  She honestly seems to be on a powertrip and expects us to jump to her calling and I refuse to.  So, should I bother trying to call the union over this or just say **** it and walk out?

Only you know if you wanna stay or go, there's all kinds of personal factors contributing to that.

But if you're gonna stay, yeah, I'd fight the HELL out of that. Use this fes's behavior as a bullying claim against her (workplace violence/harassment/intimidation are very hot tickets right now), complete with witness statements.

Be prepared, however, for management to take her side, re availability. The whole closed schedule is quickly going the way of the dinosaur, and retail especially is weeding those schedules out-------as well as the workers refusing to part with them.

Oh no you are not leaving.  If you're ready to just quit then you might as well stay and fight like hell.  File a grievance, call corporate, file a claim with your city's workforce commission, and whatever else you can think of.  Look up local attorneys in your city and pick one so you can name drop when you talk to the store manager.

You know what I did one time?  I was so mad, knew I was going to quit soon so I called the regional manager, who called the district manager, who called my store manager.  You want to guess how pissed my store manager was?  They don't like to hear from their bosses about stuff going on in their store they knew nothing about.  LOL it was great.  I stayed and gave them hell for a month before I walked in one morning and quit.

If your schedule was already approved there is nothing the new FEM can do to change it. They can schedule you no hours but if someone above you has more hours than you and it's in line with your availability and you can do the work... claim their hours as your own.

Most workers are guaranteed a minimum of 15 hours per week under the Local 1000 contract.

Find out who your stewards are.  Request a copy of your contract from them in order to see what might be done to dial back the front-end dominatrix.
