Well after 11 years with the company and until this morning, a deli/bakery back up, I was let go. The reason being I violated the social media policy. I did this when a week ago I posted that I got sick at work because of a backed up drain. That was it. But the Kroger excuse was friends of mine commented yeah it was bad and they didn't want to shop there because of it. That was why I was let go. Where was the Union? The manger himself picked one of his cronies to sit in on the meeting. So I was screwed. But it's Krogers' loss. Not mine.
Just the simple fact that a Union Rep or steward was not present is a reason for filing a grievance. Our tries use that same tactic. They grab the closest employee to sit in when someone is getting written up or warned. It's despicable how they go above and beyond to screw over employees that are otherwise ignorant to their rights. My advise to all employees is to read your union contract and memorize it. The first time they try something like this on you, simple quote the contract and they immediately back off. They are not used to employees knowing what is allowed or not.
First: I'm sorry this happened to you; keep your chin up and your head clear. If you drink or drug, don't for right now---you'll need your thoughts and emotions clear.
Second: Folks, this is a classic example of how people are so, so wrong when they say their 1st Amendment rights protect them from employer retaliation. This exact thing is increasingly happening everywhere, and I seriously recommend just leaving anything to do with where and how you make your pay checks off of social media.
In that situation YOU had the right to UNION representation.
Always carry a WEINGARTEN RIGHTS card. Talk to your steward or
UNION rep. to get one.
The following is an example of a card which an employee can either read or present to management prior to a meeting with management where the employee believes that discipline or termination may result:
"If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union representative, officer, or steward be present at this meeting. Until my representative arrives, I choose not to participate in this discussion."
Not really! The current management team is bringing the store down. Morale sucks, hours cut and starting soon they are going to start scheduling most of the help during prime-time hours, so an opener will be by themselves half the day most days. So I'm going to file for my unemployment and see what else is out there.
your claim for unemployment will likely be rejected. I would at least have the Union fight to get your job back with retro pay, find a job while it's happening and then give a 2 weeks notice.

Hey dick head social forum policy violation IS a crime on your job, that's why you can get fired for it, and that's why he did get fired for it, and you yourself agreed that that's why he would likely lose his unemployment insurance appeal.

You apparently must be illiterate or can't click links to read sources of information, but let me tell you what I posted. The NLRB states employees cannot be fired for posting and talking about work conditions regardless of policy. If the conservation was between other coworkers, which in fact I do have several on social then he could file a grievance and win. Here is an example:
Worker: I'm sick and they called me in again :(
Coworker: I've been sick and they tried to call me in too.
Like I said discussions related to work is allowed. You simply cannot go on social media posting about how Kroger sucks, I hate Kroger, etc.
