My position as an overnight stocker leaves my coworkers with overtime.  My head told all of us how management and corporate are coming down on her about it, so she came down on us.  She said that if anybody is going to have overtime for the week, then she's going to have to take a scheduled day away from the person who has the most and give it to somebody without ot.  Is this legal?

*Living in a non union state

If there's no union, they can do that. They aren't breaking the law. A lot of Kroger stores are really cracking down on OT.

Yea it's legal, and it makes sense too. Why allow one of your employees to become exhausted when you can have someone with less hours pick up their work? It's a win for everyone, even though someone is going to get less OT money.

work your 8 hours and go home dont worry about whether things get done or not

do the best you can , thats all they can ask of you

 Its to try to get the crew to do the personal pressure for her on specific offenders, Im assuming. Shes punishing other people for someone working OT.

Yeah, they want to be down our throats about over time and then last night this happened.  I told my overnight head that I'll be leaving at 5am to not accrue any overtime.  She said, well you have to stay until everything's done.  I'll be here until noon if we don't get this done together.  I said, but their complaining about overtime, so mine needs to be cut out.  Then she said how she doesn't care what they say and that I need to stay.  My day time head came in to do the grocery order, so I asked her about it.  She said if so and so says you have to stay then you have to stay.

 

Im confused...get yelled at for having overtime and then be forced to stay when you mention how you'll be going on overtime.  Makes no sense.

 

I didn't care if I stayed or not.  However, I was making it a point.

Lord that sucks blankstare, I am glad we have a good union, here they can ask you to stay but you dont have to. one time one of my managers wanted me to fill milk before I left. I was already working on something else one of the others told me to do, it was 6:50, I leave at 7, I told her that what she wanted me to do would take longer than I had and she said "do it" so I did and it was 7:30 by the time I left. FF to the next time I worked and she said "Since you worked over yesterday I am going to need you to leave early today", I went and asked my in store union person if she could really make me leave since she is the one who asked me to stay and he said no, so I told her that I would take the OT, she was pissed and she never asked me to stay late again LOL

I would do it, but I would be very clear that if you do, you want your OT, if she keeps taking it from you then I would tell her that you arent working any more OT.
