In our grocery department the overnight dp and lead positions are open, but they're never posted. Does anyone know why this is? You'd think that they'd give somebody the opportunity to apply for one of them.
Not posting open jobs is supposed to be illegal. It's a violation of the federal Equal Opportunity Employment Act, and a company can get in deep **** over this.
How they usually get around it is to post the jobs, make them seem available, then just gon on and fill em with who they wanted all along any way. Nothing you can do about that.
The only violation is likely non-compliance with your union contract . . . if that contract requires posting of open jobs. The remedy would be a grievance; the extent of the "trouble" might be a manager saying, "Going forward, we will comply with the contract."
If the job openings are supposed to be posted according to policy, you could report the noncompliance at EthicsPoint.com and see if the company chooses to enforce its own policies.
