fired for calling in sick

I have worked at kroger for about 7 months now, and today was the very first time i called my manager to call in sick. She said they do not take call ins, to which i replied that its against story policy, especially with covid, to come in sick with symptoms. She told me that i have to come in, and i said i cannot come in, as it against policy and i need to get better. She fired me on the spot and said i was unable to call in sick, as that day was a busy day, and said i was coded to be non rehire. Is this allowed? Can they fire me for calling in sick once? i have never been spoken to about poor performance or anything, this was the only reason they fired me

If you called within the time frame like 3 to 4 hours before shift and you can be sick 3 days before they require an doctor's note sounds like your manager is horrible. Contact your union rep asap

 Generally, you can not be fired over the phone per most union contracts.  You must be clocked in to get any discipline.  Call union immediately.

They CANNOT fire you over the phone. Call your Union Asap. See a doctor. If you have Covid (hopefully you do not) bring in proof. What she did was against policy. Hope it works out in your favor.

Note: I would seek a transfer to another store asap to avoid retaliation. If you continue working at your current store, she may make it miserable to work there as retaliation.

Also, they CANNOT fire you via a telephone call. It MUST be in person and whilst you are on the clock.

What a lame reason its a busy day.. and? I guess the customers will have to just wait a bit longer in lines. Call the union rep and get that bitch in hot water. If they try to get some revenge make a note of it have proof and then call the rep and tell them shes doing these things outta spite

If you're in the 90 days you are not union protected. If union protected they need to go through the proper firing sequence. If you have poor attendance during your 90 days they can term you. If you're sick more than 1 day in a row I suggest getting a dr's note. By law they can not fire you forgoing to an emergency room. Stay in network or they can force you to pay for it.

To add on: if you've had a shaky attendance record yes they can fire you for too many call outs. It's classified as job abandonment. If you're attendance is good you're fine for a day or two here or there. Frequent call outs unless you have proof they can term you after a while. If you make a regular habit out of it get a dr's note. If you need a reasonable accommodation you should of let them know sooner than later. I occasionally get anxiety attacks in the morning but by mid day I'm fine even though I'm a bit exhausted from it. A reasonable accommodation is to allow me the afternoon/evening shifts. 

If they failed to go through the proper firing sequence I suggest filing a union grievance or ethics report.

Hi, i had never missed a single day or been later before this happened, it turns out my manager just had a breakdown and attempted to fire me. I spoke with hr and the store manager and they took my side. my manager is getting suspended now lol.

 That's good. Watch out when she comes back though. She may "have it out for you" for getting her into "trouble." 

If she is apologetic that is good but EVEN THEN be wary.

Tried to call in sick.  Manager wanted to know what was wrong.  Said take Tylenol and come in for my scheduled shift, call in two or three hours and let them know.  I had a good medical reason to call off which was NONE OF THE COMPANY'S BUSINESS.  Manager informed me that a doctor's note would be required.  Company MAY NOT have the name of doctor, specialists, institution, nothing.  Don't need HR bastards threatening to sue my doctor for refusing to share information.  

Rotten lying sneaky company.  I will be gone permanently soon, and thriving.

File a union grievance asap and provide dr documentation with covid positive test. If you do not have documentation for positive test then they treat your attendance as a normal attendance protocols.

 

I'm not sure what the current protocalls for calling out have been but this is what I do know:

 

2 hrs before to call out or it counts as a no call no show.

Must call store manager at store. Digital or social media communication does not count.

 

After day 3 they will request documentation. This is why if you know you're going to be sick for a week just go to an in-network clinic and request the dr to give you 7-10 days off and by law they have to honor it. I've done this a couple times for nasty bugs. If your illness goes on longer than 10 days request fmla leave. Don't just repeatedly call out they can activate attendance protocols. It can happen quickly or I've seen some people milk it up to 1-2 years before they're let go for attendance.

 

Did they:

 

3 verbal warnings = 1 write up.

 

3 verbal warnings = 2nd write up.

 

3 verbal warnings = 3rd write up.

 

3rd write up = 1 suspension

 

Repeat 2 more times. 3rd suspension = termination.

 

If they skipped all these steps then they did not properly fire you. The only attendance that I know that can fire you is if you are 3 no call no shows. If you failed to call them before the 2 hr cut off then it's a no call no show. In this case go to the fu-cken er and get a damn dr note to excuse you for a while.

 

You can file an ethics report and union grievance. Do this asap. Every contract is different but most union contracts run between 5-15 days. Don't hesitate file one now. Some stores are slack on attendance others are not. You could of requested a dr note for a medical leave of absence for 1-2 months to protect your job.
