I have been with Kroger for 2.5 years. I did some really stupid. I saw a pack of gum on an empty cashier station. I opened it and  took a couple of pieces and put in the reshop cart. I was called into the Managers Office and received a Constructive Advice Record. It was seen on camera. I am suspended until further investigation. They have me on Probation. The Union Rep said she would fight for me. I am very dependable and will do whatever they asked me. I am a Front End Courtesy Clerk (bagger). I am 21 years old. What are my chances of beating this Stupid infraction that I did.

Your job is completely at the mercy of Kroger management in this situation.

Not trying to be rude, but I would start looking for another job if I were in your shoes.

Suspended pending investigation is more than likely their way of saying; "we need time to get your termination papers ready for you to sign."
That is what my store manager told me suspension pending investigation usually means...especially if you were caught on camera.
If they like you, you MAY get another chance. If not, then no matter what you did and how many favors you dis for them, all that will mean donkeysh*t. Theyll terminate you.
But if it's just 2 pieces of gum, they MIGHT let it slide. It's just a waiting game.

Basically, unless your have the Union file a grievance your will be terminated. "Suspended Pending" is the normal wording that is used to start the termination process, unless other information/facts are provided after you talked with the Manager you will be terminated. I have seen people fired for small stuff like this, but have also seen people that did more major things keep their jobs. If you like the job, have the Union file a grievance and see what happens. Hell, if stores are so hard up for workers, I would have thought the Manager would just scare the **** out of you and made it a teachable moment. Its interesting they took the time to find this on camera, unless someone literally spotted you in the act.

If you don't go the Union path, send the Manager/Store a notice of your voluntary resignation. With any future jobs its better to say you just quit, then have to admit you were fired for theft. Right now your still an employee, just suspended.

Just hope they dont suspend you indefinately. They can do this to prevent you from collecting unemployment. And it can also make it difficult for you to find another job
