Our local store management and District Mgr are going crazy over Corporate dragging their heels on fixing our AC. My store manager was given the excuse of "the part is not in stock"-my Fuel lead was told it was going to be another week before it is fixed. 3 of us have already contacted the Union, 1 is thinking about it and one possibly has already contracted a lawyer (with another clerk thinking about it.) Do we have any recourse-we are sitting outside with portable tall AC fans and that helps somewhat.

What have the temperatures been in the area?  What is the temperature inside the cube?

The district managers should find a way to get it fixed asap no matter what it costs.  I see, they are waiting on corporate.

Your store managers should get you a portable air conditioner.  The difficult part would be to vent the exhaust to the outside.  The vent to the outside doesn't need to be too large.

If the tall ac fans are not cooling the building, then they are not AC.

The union is your lawyer for workplace issues like this.  A grievance would get them moving faster or close the fuel center until it is fixed.  Maybe a complaint to the local news will get it fixed sooner.  But, remember, all employees are replaceable.  A lawsuit would force them to fix it.  Although, it should be fixed before anyone goes before a judge.

If someone dies or has heat stroke, then there is a civil case for a lawsuit.

Drink a lot of water.

If its that hot, why are you staffing the kiosk at all? If necessary, most fuel centers could be "unmanned". Personally, I don't understand why the Stord Mgr or District Manager didn't purchase a portable AC and then told the Facility department to figure out how to vent it outside through the door. In reality, the AC units for kiosks are not standard, how many little kiosk boxes you see at other retailers? Hell, i'm really surprised they are still building kiosks and not just open a smaller convenience store concept.

Legally they're to provide a working ventilation system. File an ethics report to move their @$$es.

We were provided alternate ventilation, plus a portable AC unit so we can sit outside. After a 2nd fuel clerk made hints on Tuesday of last week that they "would talk to a lawyer"-it was fixed the next day!!

Chances are they won't fix it. The AC at my kroger went out three weeks ago, it's been 100+ degrees so I've been doing bare minimum. No reason to kill yourself working for a company that can't even fix the AC during summer.

AC isn't required but should be especially if your kiosk building gets above an unreasonable temperature. It is required by law to have working ventilation. File an ethics report. it'll move their a$$es to get it fixed. That's how I got an ice dome in our freezer that grew to 5' tall before management would fu--cken acknowledge it. They knew about it for 6+ months too and turned a blind eye to it.

The Kroger I used to work for, our manager was a complete b!tch. We had one girl who was working the self-checkout, and this was in the colder months. Of course, she always has to be right there by the doors, opening to the lobby, which flows in all the cold air from the cart entrance and the doors. She asked if she could wear a coat and management refused. She left soon after that. Can't say I blame her.

Traditionally, fuel is a punishment department.

The AC can't keep up over 85 anyways.

The punishment is the point.

You can't make much less anywhere else.  By law.  And you'll probably get more hours.
